{"id":13307,"date":"2026-06-10T16:59:22","date_gmt":"2026-06-10T21:59:22","guid":{"rendered":"https:\/\/hammerle.com\/blog\/?p=13307"},"modified":"2026-06-10T16:59:22","modified_gmt":"2026-06-10T21:59:22","slug":"why-probate-strategy-matters","status":"publish","type":"post","link":"https:\/\/hammerle.com\/blog\/why-probate-strategy-matters\/","title":{"rendered":"Debt After Death: Why Probate Strategy Matters"},"content":{"rendered":"<p><span data-contrast=\"auto\">When a person dies, his or her relatives often rush to pay that person\u2019s credit cards and other bills.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Bad idea.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In some circumstances, a bill may never have to be paid.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">We\u2019ll\u00a0briefly explain how creditor claims work in the world of probate and then discuss an actual court decision.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h2><span data-contrast=\"none\">Independent Administration vs. Dependent Administration<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:160,&quot;335559739&quot;:80}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">Texas has an extraordinarily easy type of probate called\u00a0<\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/independent-administration-in-texas\/\"><span data-contrast=\"none\">independent administration<\/span><\/a><span data-contrast=\"auto\">, which is used for most probate estates.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In an independent administration, the administrator (or \u201cexecutor\u201d if there was a will) acts without court supervision to settle the probate estate, including paying creditor claims and distributing estate property.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">There is another type of probate called\u00a0<\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/dependent-administration-in-texas\/\"><span data-contrast=\"none\">dependent administration<\/span><\/a><span data-contrast=\"auto\">. It requires that the administrator obtain court permission before paying claims and making distributions.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Dependent administrations are not usually favored because they invariably last longer and cost more.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h2><span data-contrast=\"none\">How Probate Debts Are Handled<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:160,&quot;335559739&quot;:80}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">Now\u00a0let\u2019s\u00a0discuss debts. The\u00a0<\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/types-of-probate-in-texas\/\"><span data-contrast=\"none\">probate<\/span><\/a><span data-contrast=\"auto\">\u00a0estate\u00a0remains\u00a0liable for the decedent\u2019s debts. However, the creditor must go through a \u201cclaims\u201d process before the estate is\u00a0obligated\u00a0to pay.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">If the creditor\u00a0fumbles\u00a0the process, then an otherwise valid and collectible debt may be barred.\u00a0\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The claims process is different for independent and dependent estates: in a dependent estate, it is more complicated and subject to strict time periods.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h2><span data-contrast=\"none\">When Probate Strategy Matters<\/span><span data-contrast=\"none\">\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:160,&quot;335559739&quot;:80}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">Here is where an administrator\u2019s probate strategy pays off.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">If someone dies with a lot of debt, then it may be smarter for the administrator to choose a dependent administration and hope the creditors mess up the claims process.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Now, for our case.\u00a0 <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h2><span data-contrast=\"none\">The Case: A Homebuilder\u2019s $101,000 Claim<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:160,&quot;335559739&quot;:80}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">Bob contracted with a homebuilder to design and construct a\u00a0<\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/texas-homestead-law-requires-spouses-join-together\/\"><span data-contrast=\"none\">home in Texas<\/span><\/a><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The homebuilder asserted that it presented a draw request to Bob and demanded payment. Bob died\u00a0two\u00a0months later without having made the payment.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:1,&quot;335551620&quot;:1,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:278}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">After Bob\u2019s death, a contested probate\u00a0proceeding\u00a0began in the county court\u00a0regarding\u00a0his estate.\u00a0The Court appointed a temporary dependent administrator.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Note that this administration, like all temporary administrations, was \u201cdependent.\u201d That meant that creditors had to follow the more exacting claim process.\u00a0\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The homebuilder filed a claim for $101,000 that it said was owed under its contract with Bob.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h3><span data-contrast=\"none\">The Claim Was Rejected<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:160,&quot;335559739&quot;:80}\">\u00a0<\/span><\/h3>\n<p><span data-contrast=\"auto\">The temporary dependent administrator rejected the homebuilder\u2019s claim. In probate parlance, the claim was \u201cdisallowed.\u201d\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Now the homebuilder had to act fast.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Under the law applicable to dependent administrations, the homebuilder\u00a0was required\u00a0to\u00a0commence\u00a0a lawsuit in the court of original probate\u00a0jurisdiction\u00a0in which the estate was pending within\u00a090 days\u00a0after the rejection date, or its claim would be barred.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In other words, the homebuilder had 90 days to sue in the same county court where the estate case was pending.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h3><span data-contrast=\"none\">The Creditor Filed in the Wrong Court<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:160,&quot;335559739&quot;:80}\">\u00a0<\/span><\/h3>\n<p><span data-contrast=\"auto\">The homebuilder did not do that.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Instead, it filed its lawsuit in a district court. In its petition, it noted that its\u00a0<\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/the-art-of-the-claim-arduous-probate-process-unfriendly-for-creditors\/\"><span data-contrast=\"none\">creditor\u00a0claim<\/span><\/a><span data-contrast=\"auto\">\u00a0had been denied by the estate administrator.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The clock continued to tick.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">After the 90-day deadline had passed, the temporary dependent administrator filed a response that the district court did not have\u00a0jurisdiction\u00a0to consider the homebuilder\u2019s lawsuit because the homebuilder had filed it in the wrong court.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The appellate court agreed, and the district court case was dismissed.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h3><span data-contrast=\"none\">The Result: The Claim Was Barred<\/span><span data-ccp-props=\"{&quot;134245418&quot;:true,&quot;134245529&quot;:true,&quot;335559738&quot;:160,&quot;335559739&quot;:80}\">\u00a0<\/span><\/h3>\n<p><span data-contrast=\"auto\">The 90-day\u00a0deadline\u00a0having long passed, it\u00a0was too late for the homebuilder to file suit in the county court. Its claim was barred by statute.
