Can you imagine the court hearing\u00a0for the probate of\u00a0Jesus\u2019 will?\u00a0<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

\u201cThe Court calls In Re Estate of Jesus of Nazareth.\u00a0Counsel, could you please explain the strange phone call that you made to my court coordinator last week?\u201d\u00a0<\/span><\/i>\u00a0<\/span>\u00a0<\/span><\/p>\n

\u201cYour Honor,\u00a0we have a slight problem.\u00a0In our Application\u00a0for\u00a0Probate,\u00a0we\u00a0said\u00a0the\u00a0date of death for Jesus was on a Friday, but since then\u00a0there\u2019s\u00a0been a development.\u201d<\/span><\/i>\u00a0<\/span><\/p>\n

\u201cWhat type of development, counsel?\u201d<\/span><\/i>\u00a0<\/span>\u00a0<\/span><\/p>\n

\u201cWell, apparently\u00a0His body is missing from the tomb, and multiple people saw Him\u00a0alive\u00a03 days later.\u201d\u00a0<\/span><\/i>\u00a0<\/span><\/p>\n

\u201cCounsel,\u00a0we can only probate a person\u2019s will if he is deceased.\u00a0I\u2019ll\u00a0give you until next Monday to brief the issue\u00a0about whether\u00a0Jesus is deceased\u00a0according to the laws of Texas.\u00a0I think\u00a0that,\u00a0under the circumstances, you should\u00a0also\u00a0give notice to the beneficiaries of\u00a0His estate. How many did you say there were?\u201d<\/span><\/i>\u00a0<\/span><\/p>\n

\u201cSeveral billion, Your Honor.\u201d<\/span><\/i>\u00a0<\/span><\/p>\n

\u201cWell,\u00a0you\u2019ll\u00a0be busy.\u00a0Your case\u00a0is continued\u00a0for\u00a010 days.\u201d\u00a0<\/span><\/i>\u00a0<\/span><\/p>\n

What Does \u201cProbate\u201d Mean in Texas?<\/span>\u00a0<\/span><\/h2>\n

In Texas, \u201c<\/span>probate<\/span><\/a>\u201d refers to the legal process of administration and settlement of a decedent\u2019s estate.\u00a0It necessarily involves the courts. Confusingly, attorneys and the law use the term \u201cprobate\u201d as both a verb and a noun.<\/span>\u00a0<\/span><\/p>\n

When we refer to\u00a0the\u00a0\u201c<\/span>probate of a will<\/span><\/a>\u201d,\u00a0we mean asking a probate court (or a court with the authority of a probate court) to enter an order that recognizes the will is valid and binding.\u00a0If there are assets and debts that need to be handled further, then the court\u00a0will\u00a0open a \u201cprobate administration\u201d and appoint a\u00a0personal representative\u00a0\u2014 either\u00a0an\u00a0<\/span>executor<\/span><\/a>\u00a0or an\u00a0administrator\u00a0\u2014 to handle the\u00a0estate.<\/span>\u00a0<\/span><\/p>\n

An executor is\u00a0generally named\u00a0in a will, while an administrator is appointed by the court.\u00a0The court clerk issues \u201cletters testamentary\u201d to a qualified executor or \u201cletters of administration\u201d to a qualified administrator. These documents show that the personal representative has authority to act for the estate.\u00a0<\/span>\u00a0<\/span><\/p>\n

If the decedent\u00a0unwisely\u00a0died without a valid will\u00a0(also known as dying intestate), then we ask the court to\u00a0<\/span>determine\u00a0the decedent\u2019s heirs<\/span><\/a>, and then, perhaps, open a probate administration if one is needed.<\/span>\u00a0<\/span><\/p>\n

What Is the Probate Estate?<\/span>\u00a0<\/span><\/h2>\n

The assets\u00a0subject to\u00a0administration, along with the claims and debts that must be addressed, make up\u00a0the \u201c<\/span>probate estate<\/span><\/a>.\u201d\u00a0The goal of a probate administration is to transact all business related to the probate estate, and\u00a0ultimately settle,\u00a0partition\u00a0and distribute the estate.\u00a0<\/span>\u00a0<\/span><\/p>\n

Not every asset\u00a0is part of the probate estate. Certain bank accounts, retirement accounts, life insurance\u00a0policies\u00a0and real property may pass outside the probate process through a valid beneficiary designation, transfer-on-death designation or right of survivorship. Whether an asset is a probate asset or a non-probate asset depends on how it is titled and whether a valid designation applies.<\/span>\u00a0<\/span><\/p>\n

If there is a\u00a0<\/span>will<\/span><\/a>, then the estate is distributed according to the terms of the will. If there is not a will, then the estate is distributed\u00a0to the decedent\u2019s heirs, as\u00a0determined\u00a0by the court.\u00a0<\/span>\u00a0<\/span><\/p>\n

Independent vs. Dependent Administration<\/span>\u00a0<\/span>\u00a0<\/span><\/h2>\n

The time between appointment and distribution of the estate is busy\u00a0for the administrator\/executor.\u00a0Their actions are supervised by the probate court unless the will\u00a0stipulates\u00a0that the executor can act without court supervision, or the heirs and the court agree that no court supervision should take place.\u00a0A court-supervised administration is called a \u201c<\/span>dependent administration<\/span><\/a>.\u201d\u00a0An administration without court supervision is called an \u201c<\/span>independent administration<\/span><\/a>.\u201d\u00a0<\/span>\u00a0<\/span><\/p>\n

An\u00a0independent administration is\u00a0almost always\u00a0faster and cheaper than a dependent administration.<\/span>\u00a0<\/span><\/p>\n

Where Texas Probate Law Comes From<\/span>\u00a0<\/span><\/h2>\n

Most of the definitions and law applicable to probate are found in the\u00a0<\/span>Texas Estates Code<\/span><\/a>, but the\u00a0<\/span>Texas Government Code<\/span><\/a>,\u00a0<\/span>Texas Civil Practice & Remedies Code<\/span><\/a>\u00a0and\u00a0<\/span>Texas Rules of Civil Procedure<\/span><\/a>\u00a0make a few appearances, too. For reading enjoyment, they are on par with\u00a0Dante\u2019s\u00a0<\/span>Inferno<\/span><\/i>.<\/span>\u00a0<\/span><\/p>\n
