{"id":10947,"date":"2018-05-29T14:59:58","date_gmt":"2018-05-29T19:59:58","guid":{"rendered":"https:\/\/hammerle.com\/?p=10947"},"modified":"2020-04-13T18:31:24","modified_gmt":"2020-04-13T23:31:24","slug":"driving-after-death-the-texas-beneficiary-form-for-vehicles","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/legal-talk\/driving-after-death-the-texas-beneficiary-form-for-vehicles\/","title":{"rendered":"Driving After Death:  the Texas Beneficiary Form for Vehicles"},"content":{"rendered":"<h2>There\u2019s a new form in town:\u00a0 Beneficiary Designation for a Motor Vehicle.<\/h2>\n<p>If you own a vehicle registered in Texas, then you can name a <a href=\"https:\/\/hammerle.com\/blog\/the-lawyer-as-beneficiary\/\">beneficiary<\/a> who will take title to the car when you die.<\/p>\n<p>How do you make this happen?\u00a0 For now, you will probably have to stand in line at the county tax assessor-collector\u2019s office to submit the forms.\u00a0 You must submit the beneficiary <a href=\"http:\/\/www.txdmv.gov\/reports-and-data\/doc_download\/8518-vtr-121-beneficiary-designation-for-a-motor-vehicle\">form<\/a>\u00a0 an Application for Texas Title <a href=\"http:\/\/www.txdmv.gov\/reports-and-data\/doc_download\/998-form-130-u-application-for-texas-title-and-or-registration\">form,<\/a> the title application fee and valid ownership evidence.\u00a0 Note that you cannot just fill out the beneficiary form and leave it in your desk \u2013 it has to actually be submitted before you die to be valid.<\/p>\n<p>Now for the beneficiary\u2019s rights \u2013 just kidding, the beneficiary has no rights at all to the vehicle until you die.\u00a0 \u00a0The beneficiary has no right of possession, no right to sell or mortgage the vehicle, and no right to any proceeds from the sale of the vehicle.\u00a0 You don\u2019t even have to tell the beneficiary about the designation.\u00a0 You can revoke or change the beneficiary at any time.<\/p>\n<p>Inheriting your vehicle may be a mixed blessing to the beneficiary, especially if it there is a lien on it.\u00a0\u00a0 The lien goes along with the title \u2013 meaning that if the lender isn\u2019t paid, it can still repossess the vehicle.\u00a0 \u00a0On that happy note, your beneficiary may decide to decline any interest in the vehicle.<\/p>\n<p>The type of ownership matters; you have to own the car individually (as opposed to through a trust or business) for this to work.\u00a0\u00a0 \u00a0Things get a bit more complicated if you are just a co-owner of the vehicle.\u00a0 Joint owners also have to have a Rights of Survivorship Agreement <a href=\"http:\/\/www.txdmv.gov\/reports-and-data\/doc_download\/944-vtr-122-rights-of-survivorship-ownership-agreement-for-a-motor-vehicle\">form,<\/a> and record it with the Department of Motor Vehicles.<\/p>\n<p>Your beneficiary has to survive you by 120 hours in order to take the title.\u00a0 To actually get the title, your beneficiary has to submit a title application <a href=\"http:\/\/www.txdmv.gov\/reports-and-data\/doc_download\/998-form-130-u-application-for-texas-title-and-or-registration\">form<\/a> within 180 days of your death, together with the title application fee, the original Texas title (or a print-out from the county tax assessor-collector) and a death certificate.\u00a0 The state is pretty serious about the timing on this \u2013 the beneficiary loses out if the form is not timely submitted, and the car will then have to be transferred through an heirship or probate proceeding.<\/p>\n<p>Practice pointer \u2013 if you make a beneficiary designation, tell somebody or at least leave the information where someone can find it before the 180 days expire.<\/p>\n<p>Like beneficiary designations on bank accounts and investments, the beneficiary designation for a motor vehicle trumps the provisions in your will.\u00a0 Suppose you make a beneficiary designation on your BMW title to your son,\u00a0<em>Adam<\/em>, but in your will you leave your BMW to your daughter, Alice.\u00a0 <em>Adam<\/em> wins.\u00a0 It doesn\u2019t matter if you made your will before or after you submitted the title beneficiary designation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>There\u2019s a new form in town:\u00a0 Beneficiary Designation for a Motor Vehicle.
