{"id":11484,"date":"2019-09-10T15:24:42","date_gmt":"2019-09-10T20:24:42","guid":{"rendered":"https:\/\/hammerle.com\/?p=11484"},"modified":"2023-02-08T11:05:55","modified_gmt":"2023-02-08T17:05:55","slug":"what-happens-to-your-debt-and-assets-when-you-die","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/probate\/what-happens-to-your-debt-and-assets-when-you-die\/","title":{"rendered":"This Is What Happens To Your Debt and Assets When You Die"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Unfortunate fact: your debts do not die with you.\u00a0 They continue to burden your property after your death.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is a big deal.\u00a0 Your creditors can go after the property that goes through your probate estate and the property that passes under beneficiary designation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is fair to say that your <a href=\"https:\/\/hammerle.com\/blog\/4-common-mistakes-beneficiary-designations\/\">beneficiaries<\/a> or heirs take their share of your property under the threat that it may be pulled back by a creditor.\u00a0 For that reason, they should pause for a good long while before spending their inheritance.\u00a0\u00a0<\/span><\/p>\n<h2>What Happens To My Properties After I Die ?<\/h2>\n<p><span style=\"font-weight: 400;\">There are some rules about the order in which property gets pulled back into the estate.\u00a0 If you left a will that addresses the payment of debts and administration expenses, then the provisions in your will control those.\u00a0 Absent that, the statute sets out the order in which property is liable for your debts and expenses, other than estate taxes. There are six categories as follows.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">First, any property that passes by <a href=\"https:\/\/www.law.cornell.edu\/wex\/intestacy\">intestacy<\/a> (the disposition is not controlled by a will).\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Second, property from your <a href=\"https:\/\/www.bequeathed.org\/wills\/what-to-include-in-a-will\/residuary-estate\">residuary<\/a> estate (this is what remains in your estate after the specific bequests and devises from your will have been satisfied).\u00a0 Out of this, personal property is first, then <a href=\"https:\/\/hammerle.com\/defining-real-estate-real-property-law\/\">real property<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Third, general bequests of personal property.\u00a0 An example would be: \u201c$10,000 to my niece Lucy.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fourth, general devises of real property.\u00a0 If you think that category is confusing, then you will be happy to know that the courts agree.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fifth, specific bequests of personal property.\u00a0 An example would be:\u201d all of my shares in my Apple stock to my son.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sixth, specific bequests of real property, such as \u201call of my mineral interests to my wife.\u201d<\/span><\/p>\n<h2><strong>You Can&#8217;t Cheat The Creditor Entitlement<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">There is another category of property that is burdened with a mortgage or is used to collateralize a loan.\u00a0 The creditor is always entitled to pursue the collateral.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The property that passes by a beneficiary designation, such as a multi-party bank account, has to bear its proportionate share of estate taxes.\u00a0 It can also be pulled back into an estate to pay other debts if the assets of the estate are insufficient.
