{"id":11587,"date":"2019-12-01T07:03:13","date_gmt":"2019-12-01T13:03:13","guid":{"rendered":"https:\/\/hammerle.com\/?p=11587"},"modified":"2025-06-18T17:28:34","modified_gmt":"2025-06-18T22:28:34","slug":"legal-vs-ethical-responsibilities","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/probate\/legal-vs-ethical-responsibilities\/","title":{"rendered":"Legal vs Ethical Responsibilities"},"content":{"rendered":"<h2><span style=\"font-weight: 400;\">The Post-Thanksgiving Blues<\/span><\/h2>\n<h2><span style=\"font-weight: 400;\">Reflections Bring Good Cheer<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">With any luck, you have finished waving goodbye to the last of the relatives and returned to your home.\u00a0 Home, a place where you can reminisce in private about all of the real and imagined slights, jabs and jibes made by that graceless, greedy, egocentric, are-you-sure-we-are-even-related mob.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Too soon?\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s steer your emotions towards a more productive use by reflecting on the differences between your moral obligation and your legal obligation to your family.<\/span><\/p>\n<h2>What Things Aren&#8217;t Considered Your Legal Obligation?<\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to support your child after he or she reaches the age of 18. That includes college, counseling, clothes, cell phone, food and insurance.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to provide anything other than necessaries for your spouse. \u00a0 For most people, that knocks out the Lexus, the caviar and the second home.\u00a0\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to support your parents.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to support your siblings or their spouses.\u00a0\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to support your step-children.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to support your ex-spouse.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to support your significant other, and that goes double for his or her children, friends and pets.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to name your children as beneficiaries in your <a href=\"https:\/\/hammerle.com\/blog\/how-to-write-a-will-in-texas\/\">will<\/a>.\u00a0\u00a0\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to name your children as beneficiaries of your retirement account, life insurance, or investment accounts.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to name your <a href=\"https:\/\/hammerle.com\/blog\/4-common-mistakes-beneficiary-designations\/\">spouse as beneficiary in your will<\/a>.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to name your spouse as beneficiary of your life insurance or investments. (You may have a legal obligation to name your spouse beneficiary of your retirement account, but that is another column.)\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to treat your children equally.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to divide your estate evenly among your children.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to designate the eldest of your children as your primary agent under your financial and <a href=\"https:\/\/hammerle.com\/legal-practice-areas-lawyer\/elder\/wills-and-trusts\/\">medical powers of attorney<\/a>. Birth order is irrelevant.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to share your financial information with your children, consult with them before you make a financial decision, or include them in your estate planning.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">You have no legal obligation to listen to your relative\u2019s gossip or to put up with mean-spirited behavior.\u00a0\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">That is a lot of freedom.\u00a0 So how can you mess it up?
