{"id":11593,"date":"2019-12-08T07:03:43","date_gmt":"2019-12-08T13:03:43","guid":{"rendered":"https:\/\/hammerle.com\/?p=11593"},"modified":"2025-06-18T17:27:16","modified_gmt":"2025-06-18T22:27:16","slug":"what-is-the-2019-gift-tax-limit","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/estate-planning\/what-is-the-2019-gift-tax-limit\/","title":{"rendered":"What Is The 2019 Gift Tax Limit?"},"content":{"rendered":"<h2><span style=\"font-weight: 400;\">The Law of Frying Pans<\/span><\/h2>\n<h2><span style=\"font-weight: 400;\">Making Your Gifts Cook<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">\u2018Tis the season for giving and receiving gifts.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So here \u2018tis your first gift of the season:\u00a0 a primer on the law of gifts.<\/span><\/p>\n<h2>What Is Considered A Gift?<\/h2>\n<p><span style=\"font-weight: 400;\">Simply stated, <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/gift-tax\">a gift is a voluntary transfer of property made gratuitously<\/a>.\u00a0 There is, of course, a bit more to it. The owner has to intend to give the property, the property has to be delivered, and the property has to be accepted.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, if you hand your brother your frying pan while saying \u201cthis is my gift to you,\u201d and your brother says \u201cthank you\u201d, then it is a gift. \u00a0 You have intent, delivery and acceptance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0If your brother comes into your kitchen and forces you to give him your frying pan, then it is not a gift because the transfer is not voluntary.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you demand that your brother pay you $10 for your frying pan, then it is not a gift because you expect payment.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you tell your brother \u201cI am giving you my frying pan\u201d but you do not hand it to him, then it is not a gift because it was not delivered.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you hand your brother your frying pan and he says \u201cI don\u2019t want this piece of junk,\u201d then it is not a gift because it was not accepted.\u00a0 Plus, your brother is rude.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you hand your brother your frying pan and say \u201cthis is my gift to you,\u201d but you did not mean it, then it is not a gift because you did not have the required intent to make a gift.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The burden of proving that a transfer is a gift is on the person claiming the gift.\u00a0 Thus, your brother has the burden to prove that he received the frying pan from you as a gift.<\/span><\/p>\n<h2>Giving Gifts To Your Spouse and Children<\/h2>\n<p><span style=\"font-weight: 400;\">Some classes of recipients have an easier burden to prove a gift.\u00a0 A transfer from a parent to a child is presumptively a gift. If you hand your child a computer and say \u201cI give this to you,\u201d\u00a0 then you can only overcome the presumption that it was a gift by clear and convincing evidence.
