{"id":12003,"date":"2020-06-21T07:03:29","date_gmt":"2020-06-21T12:03:29","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=12003"},"modified":"2025-06-18T17:43:21","modified_gmt":"2025-06-18T22:43:21","slug":"how-to-deal-with-squatters","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/real-estate\/how-to-deal-with-squatters\/","title":{"rendered":"Shedding the Unwanted Houseguest &#8211; A Road Map to Deal with Squatters"},"content":{"rendered":"<p>\u201cFriends, Relatives, In-laws, lend me your ears.\u00a0 I have come to bury our relationship, not to praise it.\u00a0 You need to leave my house now.\u201d<\/p>\n<p>Feel free to tweak the foregoing to fit your situation.\u00a0 Shakespeare most assuredly will not mind.<\/p>\n<p>There are few situations more fraught with anxiety than dealing with a houseguest turned squatter.\u00a0 You might be dealing with an adult child who moves back home for \u201cjust a few weeks\u201d and is still sitting in your basement playing video-games 6 months later, or a close friend who gets evicted and just needs to place to \u201cspend a night\u201d and then has his mail forwarded to your home, or a mother-in-law who comes to temporarily help out with the kids and arrives with 8 suitcases and her dog.\u00a0 No matter how initially welcome your guest, there will come a point in time when you want them gone and your house back.<\/p>\n<p>That can be an extraordinarily difficult conversation to have.\u00a0 It might even be a dangerous one if you have been saddled with a true exploiter.<\/p>\n<p>So let\u2019s start by looking at the law.<\/p>\n<p>If your houseguest has been there for a while, he or she has probably achieved tenant status in your house.\u00a0 Surprise!\u00a0 If that is the case, you cannot oust him by simply piling his belongings on the sidewalk and locking the door behind him.\u00a0 As painful as it seems, your houseguest has rights.\u00a0\u00a0 How many rights he has depends on the nature of his tenancy.<\/p>\n<p>A tenant by sufferance is someone who has entered into your house under a written or oral agreement for a set term, and then holds over after the term expires.\u00a0 If, for example, you told your daughter she could move home for 3 months, then at the end of the 3<sup>rd<\/sup> month she becomes a tenant by sufferance.\u00a0 Because she no longer is on the property with your consent, this type of tenant has the least rights.<\/p>\n<p>A tenant at will is someone who came onto your property with your consent.\u00a0 You or the tenant can terminate the arrangement at any time.<\/p>\n<p>A tenant under a written lease or oral rental agreement has the most rights.\u00a0 He has a right to occupancy during the term of lease.\u00a0 You cannot terminate his lease without an acceptable reason.<\/p>\n<p>To get rid of a tenant by sufferance or a tenant at will, you have to give that person at least 3 days written notice.
