{"id":12057,"date":"2020-08-16T07:03:22","date_gmt":"2020-08-16T12:03:22","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=12057"},"modified":"2025-06-18T17:18:26","modified_gmt":"2025-06-18T22:18:26","slug":"explaining-laws-of-descent-and-distribution","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/probate\/explaining-laws-of-descent-and-distribution\/","title":{"rendered":"Explaining Laws of Descent and Distribution"},"content":{"rendered":"<p>Let rich Aunt Meg die without a will and then just wait for the swarm of heirs to descend on her estate.\u00a0 You won\u2019t be able to move through her mansion living room without stepping on one.<\/p>\n<p>There is an orderly process of inheritance under the law.\u00a0 It is called the law of descent and sets out the order that Aunt Meg\u2019s kindred will inherit.\u00a0A kin who steps into line to inherit is an heir.\u00a0An in-law or step-child is considered neither kindred nor descendant and will not inherit.<\/p>\n<p>All heirs are not treated equal.\u00a0The law of distribution spells out the share of the estate to which each class of heirs is entitled.<\/p>\n<p>The laws of descent and distribution only come into play if Aunt Meg does not leave a will that distributes her entire estate.\u00a0Interestingly, Aunt Meg can leave a will that distributes only part of her estate and then disinherits one of her heirs.<\/p>\n<h2><strong>What are the Laws of Descent and Distribution?<\/strong><\/h2>\n<p>So what is the law of descent?\u00a0To explain it, let\u2019s go back to Aunt Meg.<\/p>\n<p>If Aunt Meg is married at the time she died, then her primary heir is her husband and any children she had from a prior marriage.\u00a0If she is not married, then her primary heirs are her children.\u00a0 If a child has predeceased her, then that child\u2019s share goes to the child\u2019s descendants.\u00a0So if Aunt Meg died leaving 3 living children and 1 deceased child, then the distribution would be as follows:\u00a0 the 3 living children each receive 25% of the estate, and the deceased child\u2019s share will be distributed among his or her children.<\/p>\n<p>If Aunt Meg did not leave a surviving spouse and did not have any children, then next up are Meg\u2019s surviving parents. Here is where it gets interesting.\u00a0If both her mother and father survived, then they share Meg\u2019s estate equally.\u00a0However, if Meg is survived by only one parent, then Meg\u2019s estate is divided into two parts.\u00a0One part goes to her surviving parent, and the other part goes to Meg\u2019s siblings and their descendants.\u00a0If Meg had no siblings, then her \u00a0surviving parent gets all of the estate.<\/p>\n<p>If poor Meg died without leaving a surviving spouse, child or parent, then her estate goes to her siblings and their descendants.\u00a0If we strike out there, then we split Meg\u2019s estate into two parts and go back up the family tree.\u00a0One-half will go to her father\u2019s kindred and the other half will go to her mother\u2019s kindred.<\/p>\n<p>It can get messy.<\/p>\n<p>Sometimes people get a bit confused while writing a <a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning-and-probate\/how-to-write-a-will-in-texas\/\">will<\/a> or <a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning-and-probate\/how-to-settle-an-estate-with-a-trust\/\">trust<\/a> and leave a bequest to their \u201cheirs.\u201d Don\u2019t do that \u2013 it just causes problems.<\/p>\n<p>The world of heirship has led to some intriguing cases.\u00a0Suits have been brought to determine the rights of adoptive children, adoptive parents, common law spouses and putative spouses.\u00a0Family secrets, long thought safe, are dragged out into the open.
