Your widowed mom, may she rest in peace, lived, and died, in Texas. She was survived by you and your 4 siblings, all unruly rascals who think \u201csmash and grab\u201d is an acceptable shopping technique.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In her profound wisdom, your mom left behind a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/how-to-write-a-will-in-texas\/\"><span style=\"font-weight: 400;\">will<\/span><\/a><span style=\"font-weight: 400;\"> that named you as her independent executor and left everything to be divided among her 5 children. You decide to accept the role of independent executor because if you did not then one of your thieving brothers or sisters would be appointed and your inheritance would mysteriously disappear.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Accordingly, you <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/legal-talk\/7-times-when-you-need-a-lawyer\/\"><span style=\"font-weight: 400;\">hire a lawyer<\/span><\/a><span style=\"font-weight: 400;\">, file the will for probate, and get appointed independent executor of your mom\u2019s estate. Now what?<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What To Do After Being Named Executor<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">It is simple, really: you gather assets, <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/what-happens-to-your-debt-and-assets-when-you-die\/\"><span style=\"font-weight: 400;\">pay debts<\/span><\/a><span style=\"font-weight: 400;\">, and make distributions to the <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/beneficiary-in-waiting-rights-during-the-probate-process-can-be-complex\/\"><span style=\"font-weight: 400;\">beneficiaries<\/span><\/a><span style=\"font-weight: 400;\"> against a backdrop of court deadlines, notification deadlines, and tax deadlines, all overlaid with fiduciary duties.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Specifically, within 1 month you must publish a Notice to Creditors. Within 2 months you must mail a notice to the secured creditors of mom\u2019s estate, and you may want to give discretionary notice to the unsecured creditors, too. Within 90 days you must file an inventory, appraisement and list of claims, or an affidavit in lieu of inventory.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hiring a CPA is helpful because there are tax things you must do. You should get a federal tax number for your mom\u2019s estate and file a fiduciary notification form. No later than the 15<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> day of the 4<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> month after the close of the calendar year, you must file your mom\u2019s final tax return. For tax purposes, you can use values either as of your mom\u2019s date of death or 6 months after her date of death. You may need to file a federal form 706 within 9 months of the date of her death. You also may need to file an income tax return for the estate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You should invest in a financial software package to keep up with your record keeping because you have a duty to <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/list-of-estate-planning-document-essentials\/\"><span style=\"font-weight: 400;\">keep records and accounts<\/span><\/a><span style=\"font-weight: 400;\">. Set up an estate bank account, consolidate your mom\u2019s accounts, look in her <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/safe-deposit-boxes-what-to-store-and-not-to-store\/\"><span style=\"font-weight: 400;\">safety deposit box<\/span><\/a><span style=\"font-weight: 400;\">, and notify the financial institutions who issued credit or debit cards to your mom.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ah, but those are in the future.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">An Executor\u2019s Immediate Duties\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Your <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/the-morning-after-executors-role-after-a-death\/\"><span style=\"font-weight: 400;\">immediate duties<\/span><\/a><span style=\"font-weight: 400;\"> may be more demanding. You may need to quickly take charge of your mom\u2019s pets, change locks on your mom\u2019s house, stop deliveries and utilities as appropriate, place valuables in a secure location, inventory personal items, confirm assets are covered by insurance, and store automobiles. At some point, depending upon the terms of the will, you will want to divide personal property.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Above all, you don\u2019t want to provoke hostilities where they can be avoided. You should be <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/business-law\/royal-pain-in-the-arse-dealing-with-unruly-members-in-family-business\/\"><span style=\"font-weight: 400;\">sensitive to the feelings of your siblings <\/span><\/a><span style=\"font-weight: 400;\">and communicate with them regularly. Changing the locks should be described as \u201ckeeping mom\u2019s things safe until we can divide them.\u201d If mom\u2019s will states that her personal possessions should be divided among her children, then you should ask for their participation in making the decisions. If they can\u2019t decide, then you devise the system \u2013 picking numbers, asking for a list from each beneficiary, or selling everything at an estate sale.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That is but the first chapter in the story that is your mom\u2019s probate.
