Specifically, homestead protections against creditors after a homeowner dies.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s look at a hypothetical family: husband Doug and wife Lisa, who live happily in Doug\u2019s $450,000 home in Texas.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Doug dies. Three days later Lisa gets a call from the credit card company demanding payment of $50,000 on their past-due account. She is very worried that the credit card company will seize Doug\u2019s house and toss her out on the street.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">She should not be \u2013 Texas homestead law will ride to the rescue.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What is Texas Homestead Law?\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">When Doug died, a \u201c<\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/probate-homestead-the-right-of-occupancy\/\"><span style=\"font-weight: 400;\">probate homestead<\/span><\/a><span style=\"font-weight: 400;\">\u201d automatically arose on the house because he was survived by a spouse. It vested immediately upon Doug\u2019s death. It did not matter that the homestead was Doug\u2019s separate property. The probate homestead exists for both separate and community property.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A probate homestead is exempt from regular creditor claims, such as those asserted by a credit card company. And not just credit card claims \u2013 there are very few creditors who are not blocked by a probate homestead. The lucky few who can get around the exemption include mortgage companies and the government for tax liens.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s move the scenario along. Suppose that Lisa decides she can\u2019t afford to keep the home and sells it. Game over? Not at all. The proceeds from the sale are still exempt from creditor claims, for up to six months after the sale. After that, the exemption expires. However, Lisa can be shrewd about it. If she invests the money in another property within those six months, then the new property receives the same protection as the probate homestead.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Does that mean the credit card company will never get paid? No. When Lisa dies, the exemption from the probate homestead arising from Doug\u2019s death expires.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">How Does Probate Homestead Affect Community Property?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Now let\u2019s change the game. Suppose Doug and Lisa\u2019s house was purchased during their marriage and is <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/community-property-state-rules-explained-who-gets-what\/\"><span style=\"font-weight: 400;\">community property<\/span><\/a><span style=\"font-weight: 400;\">. When Doug dies, Lisa has double protection. She has her own homestead exemption that arises from her ownership of the property, and she has the probate homestead exemption that arises from Doug\u2019s death.\u00a0\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">How Does Probate Homestead Affect Your Spouse and Children?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Brand new scenario. Let\u2019s suppose that Doug and Lisa have a 1-year-old child, baby Lenny, and the house is owned by Doug as his separate property.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Doug dies. Who has the homestead exemption?\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">They both do. Lisa, because she is the surviving spouse. Baby Lenny because he is Doug\u2019s minor child. If Lisa then dies, baby Benny still has his own probate homestead exemption.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">What Happens If You Leave the Homestead?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">What if Lisa decides she\u2019s had enough, abandons the homestead and moves into an apartment? The homestead exemption is still valid. It takes a lot to lose it. Lisa must merely have an intention to return to the homestead to keep the exemption. Her physical absence, alone, is not enough to prove abandonment. She can rent the homestead or offer to sell it, and that still does not prove abandonment. A creditor claiming the homestead exemption no longer exists must prove it beyond the shadow of all reasonable doubt.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">The History of Probate Homestead<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The probate homestead has a long history in Texas. Take a look at the 1914 Texas Supreme Court case <\/span><a href=\"https:\/\/casetext.com\/case\/hoefling-v-hoefling\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Hoefling v. Hoefling<\/span><\/i><\/a><span style=\"font-weight: 400;\">, the 1952 Texas Supreme Court case <\/span><a href=\"https:\/\/law.justia.com\/cases\/texas\/supreme-court\/1952\/a-3643-0.html\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Butler v. Summers<\/span><\/i><\/a><span style=\"font-weight: 400;\">, the 1884 Texas Supreme Court case <\/span><i><span style=\"font-weight: 400;\">Watkins v. Davis<\/span><\/i><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/texas.public.law\/statutes\/tex._est._code_section_102.004\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Texas Estates Code Section 102.004<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/codes.findlaw.com\/tx\/property-code\/prop-sect-41-001\/#:~:text=(c)%20The%20homestead%20claimant's%20proceeds,after%20the%20date%20of%20sale.&amp;text=FindLaw%20Codes%20may%20not%20reflect,the%20law%20in%20your%20jurisdiction.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Texas Property Code Section 41.001(c)<\/span><\/a><span style=\"font-weight: 400;\"> for some background.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Probate homestead law may be complicated, but it is very important to surviving spouses and minor children.\u00a0\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Do You Need Probate Assistance?
