They seldom want to deal with patients\u2019 relatives. Why? Relatives, especially parents, tend to ask awkward questions like \u201cWhy have you given so much medication to my adult child that he is a walking zombie?\u201d and \u201cHow was my adult child magically cured on the very same day his<\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/real-estate\/a-policy-in-house-storming-insurance-coverage\/\"><span style=\"font-weight: 400;\"> insurance coverage ran out<\/span><\/a><span style=\"font-weight: 400;\">?\u201d<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Understanding Psychiatric Power of Attorney<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Institutions often duck the issues by demanding that you first provide them with a \u201cPsychiatric Power of Attorney\u201d or similar document signed by your <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/legal-talk\/the-mentality-of-mental-illness-no-cure-means-creative-action\/\"><span style=\"font-weight: 400;\">mentally ill<\/span><\/a><span style=\"font-weight: 400;\"> adult child. Without these documents, they will refuse to confirm that they even know your adult child.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Unfortunately, Texas law does not specifically authorize a Psychiatric Power of Attorney. Instead, you will need to cobble together three documents to get you there hopefully. All three of these documents must be executed by your child during a period of lucidity.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Documents for Psychiatric Power of Attorney<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">1. Declaration of Mental Health Treatment<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The first document is the Declaration of Mental Health Treatment. The statutory authority and form for the document are hidden in plain sight in the <\/span><a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/CP\/htm\/CP.137.htm\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Civil Practice &amp; Remedies Code, Chapter 137<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Declaration is your adult child\u2019s statement of preferences or instructions regarding mental health treatment. He may even include a consent to or refusal of mental health treatment. The Declaration is effective when it is executed.<\/span><\/p>\n<h4><span style=\"font-weight: 400;\">Important Details of the Declaration of Mental Health Treatment<\/span><\/h4>\n<p><span style=\"font-weight: 400;\">Surprisingly, the Declaration expires three years after it is executed. There is a grace period if your child is incapacitated on the date it would otherwise expire; in that case, it continues in effect until your child is no longer incapacitated. Your child must sign the declaration in the presence of two witnesses, or it must be signed in front of a notary public. If witnesses are used, then certain people such as relatives, heirs, beneficiaries, and employees of the health care provider are prohibited from serving.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The institution and your child\u2019s doctor are required to follow the instructions in the Declaration. If, at the time, your child can provide informed consent, then they must seek your child\u2019s approval for all <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/mental-health-and-guardianship\/\"><span style=\"font-weight: 400;\">mental health treatment decisions<\/span><\/a><span style=\"font-weight: 400;\">. However, the doctor can ignore the Declaration if there is an emergency and your child\u2019s instructions have not reduced the severity of his behavior, or if there is a court order for mental health services.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">2. HIPAA Release<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Enter the second document: the HIPAA release. This is your adult child\u2019s written permission to the world to release all your child\u2019s medical information to you. Using the HIPAA release, you should be able to go into a facility or doctor\u2019s office and obtain any medical information they have on your child. This will also, indirectly, confirm when they have provided medical services to your child.<\/span><\/p>\n<h3>3. Medical Power of Attorney<\/h3>\n<p><span style=\"font-weight: 400;\">Once you have the information, then the trick is to get the doctors to talk to you about your child\u2019s condition and treatment. This is where you hand over the third document: the <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/why-a-medical-power-of-attorney-is-important\/\"><span style=\"font-weight: 400;\">Medical Power of Attorney<\/span><\/a><span style=\"font-weight: 400;\">.
