Let\u2019s focus on one protection that consistently catches people by surprise: joinder.\u00a0\u00a0\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What is Joinder?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Under the law of joinder, one spouse cannot sell, convey, or encumber the family homestead without the joinder of the other spouse. This prohibition applies to both community and separate property.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">How Joinder Works<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">You and your spouse own and live in a house that is your family homestead.\u00a0 You want to add a pool. Your spouse does not. Unfortunately, you cannot pay cash and will need to take out a loan secured by the house to build the pool.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Good luck with that. Because of homestead laws, you cannot pledge your house as collateral without your spouse\u2019s joinder. No collateral means no loan and no loan means no pool.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That, you think, is understandable. You reason that the homestead is <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/community-property-state-rules-explained-who-gets-what\/\"><span style=\"font-weight: 400;\">community property<\/span><\/a><span style=\"font-weight: 400;\">, and both of you should agree before it can be pledged as collateral. Unfortunately, you are only partially right. To see why, let\u2019s look at the next example.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Family Homestead Protections in Action<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Home Loans for the Homestead<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">You own the house before you get married. It is only in your name. It is your separate property.\u00a0 After you are married, you want to put in a new pool. Your spouse does not want a pool. To your surprise, the lender will not loan you money unless your spouse signs off on the deed of trust pledging your property as collateral.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Wait \u2013 why is that? It is your separate property, you are signing the loan, and your spouse should have nothing to do with it, right? Wrong \u2013 remember the drunken and worthless husband rule. Texas homestead law is clear \u2013 a homestead cannot be encumbered without the joinder of both spouses.\u00a0 Whether the house is owned by one or both of you is irrelevant. The protections arise because the property is a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/legal-talk\/yours-mine-and-ours-texas-community-property-explained\/\"><span style=\"font-weight: 400;\">family homestead<\/span><\/a><span style=\"font-weight: 400;\">. The same rule applies to the sale of the homestead. Let\u2019s see how that looks.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Selling the Family Homestead<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">You own the house before marriage, and you and your spouse live in it after marriage. It is your family homestead. You have a fight with your spouse that results in your spouse temporarily moving out. You then list your homestead for sale. The title company refuses to allow you to sell it unless your spouse joins in the sale.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Surely that can\u2019t be right?\u00a0 Oh, but it is. Homestead law requires the joinder of your spouse in the sale.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Determining a Valid Joinder<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Silence, by the way, does not constitute a valid joinder. Consider this Texas case. Gerald married Wanda and moved into her house. Fourteen years later, Wanda deeded her house to her daughter from a previous marriage. Gerald said nothing. After Wanda moved into a nursing home, her daughter tried to evict Gerald. The daughter lost. Gerald\u2019s silence was not a joinder in the deed.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Avoiding the Joinder Requirement<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">There are 2 circumstances where you can avoid the joinder requirement.\u00a0\u00a0<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The first is when your spouse has been judicially declared incapacitated by a court with original <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/what-is-a-guardianship-in-texas\/\"><span style=\"font-weight: 400;\">guardianship<\/span><\/a><span style=\"font-weight: 400;\"> jurisdiction.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The second happens when a court has found that your spouse has disappeared, permanently abandoned you and the homestead, or is a POW.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">If either of those occurs, then you can sell, convey, or encumber the homestead without the joinder of your spouse.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Hammerle Morris Law Firm is Here to Help With Your Homestead<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You just don\u2019t mess around with Texas homesteads.
