In a Limited guardianship, only certain rights are removed. Judges will only consider removing what is necessary to protect the ward.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Rights That Can Be Removed<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Own, possess, or purchase a firearm<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make personal decisions regarding residence<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make decisions regarding marriage<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make decisions regarding medical or dental treatment<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make decisions regarding psychological or psychiatric treatment<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make any gift of <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/personal-property-definitions\/\"><span style=\"font-weight: 400;\">personal property<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Handle any bank, financial, or investment accounts<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Apply for credit of any kind<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Operate a motor vehicle<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contract for goods or services<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Vote in a public election<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In removing <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/giving-up-rights-as-you-age-experience-wisdom-key\/\"><span style=\"font-weight: 400;\">rights<\/span><\/a><span style=\"font-weight: 400;\">, a judge will need to appoint a guardian to take over the tasks and responsibilities of the ward. Giving certain rights to a guardian helps them advocate and protect the individual.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Rights That Can Be Assigned to a Guardian<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The right to have physical possession of Ward<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Establish Ward\u2019s legal domicile<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The power to arrange for Ward\u2019s food and housing needs<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The power to apply for, arrange, and consent to all <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/informed-consent\/\"><span style=\"font-weight: 400;\">medical<\/span><\/a><span style=\"font-weight: 400;\"> and dental care including, but not limited to, medical tests, examinations, and the administration of medication, as required and needed by Ward<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The power to apply for, arrange, and consent to all psychological tests and evaluations that may be needed by Ward other than the inpatient psychiatric commitments of Ward<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The power to apply for and receive and apply for public, private, and governmental benefits and\/or funds from state or federal government sources for Ward\u2019s benefit<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The power to apply for and secure governmental services for Ward<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The power to apply for and secure an identification card for Ward<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The power to consent to the disclosure of Ward\u2019s confidential records<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The power to execute all documents necessary to facilitate employment<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To gain access to all of Ward\u2019s financial records<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">While these rights can be customized to meet the needs of the ward, the rights above are \u201ctypical\u201d of what a Guardian of the Person could include.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Understanding Guardianship of the Person<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">As you can see there is a great level of responsibility when deciding if guardianship is right for the situation.
