She dies. You want to be efficient, so you go ahead and pay her credit card bills as usual.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Was that a good idea? No, it was not.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Death marks an end to business-as-usual for financial matters.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">The Different Classes of Claims<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You should no longer view your mom\u2019s bills as automatically payable. They must be turned into <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/the-art-of-the-claim-arduous-probate-process-unfriendly-for-creditors\/\"><span style=\"font-weight: 400;\">claims<\/span><\/a><span style=\"font-weight: 400;\">, which are then ranked by class. There are eight classes of claims. Class 1 claims get the highest priority and are paid first. The next classes are paid in order. Often an estate doesn\u2019t have enough assets to pay all of the claims.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Before any class claims get paid, however, three other types of claims must be paid first. These are\u00a0<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">US government claims (such as <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/not-even-taxes-can-stop-death-the-impact-of-expectations\/\"><span style=\"font-weight: 400;\">taxes<\/span><\/a><span style=\"font-weight: 400;\">)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The allowance in lieu of homestead.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Preferred debts and liens.\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Only when those have been satisfied can you turn to the class claims.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Class 1 \u2013 Funeral and last illness expenses. Then comes the family allowance.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Class 2 \u2013 Administrative expenses.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Class 3 \u2013 Matured secured claims.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Class 4 \u2013 Child support.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Class 5 \u2013 State taxes.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Class 6 \u2013 Incarceration costs.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Class 7 \u2013 <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/legal-talk\/beware-of-merp-in-texas\/\"><span style=\"font-weight: 400;\">MERP<\/span><\/a><span style=\"font-weight: 400;\"> (Medicaid Estate Recovery Program).\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Class 8 \u2013 Anything else (such as credit card bills).<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">Why You Shouldn\u2019t Rush to Pay Claims<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">When you look at the big picture, you can see that rushing to pay your mom\u2019s credit card debt is a huge mistake. Credit card debt falls last on the spectrum. How do you know there will be enough money to reach the last class until after you have valued your mom\u2019s estate and the amount of the higher-ranked claims?\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are two other reasons why you should not rush to pay claims.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">1. Lack of Authority<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The first is that you don\u2019t have the authority to pay a claim from your mom\u2019s estate. That only comes after her estate has been probated and you have been named as her estate representative, e.g. <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/independent-executorship-in-texas\/\"><span style=\"font-weight: 400;\">independent executor<\/span><\/a><span style=\"font-weight: 400;\">, independent administrator, dependent executor, or dependent administrator.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">2. Statute of Limitations<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The second is that her estate may not owe the claim at all because the statute of limitations has run, the claim can be successfully disputed, or the creditor botches the claims process.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Texas has helpfully set out an orderly way for a creditor to make a claim against a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/some-executors-find-it-difficult-to-distribute-probate-estates\/\"><span style=\"font-weight: 400;\">probate estate<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Understanding the Creditor\u2019s Process<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Several processes come into play, depending upon the type of administration and the type of claim. The type of process the creditor must follow depends upon the answer to these four questions:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Is it a money claim or another type of claim?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Is it an unsecured claim or a secured claim?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Did the estate representative give permissive notice when appropriate?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Is it a dependent or independent administration?<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The process is complicated. For every one of the questions, there are definitions and case law. What is a money claim? What is permissive notice and when is it appropriate? What is a secured claim?<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Example of a Money Claim<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Let\u2019s go through a quick example of a money claim under a dependent administration where the creditor received permissive notice.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The claim must:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Be presented within 120 days.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Be signed by the creditor.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">State the amount claimed, the claim classification, and, if it is secured, an election for treatment.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Be supported by an affidavit.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Include all exhibits and vouchers to prove the claim.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">And that\u2019s just for starters.
