The driver, an 84-year-old female, accidentally hit the accelerator instead of the brake.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In February 2024, an elderly male driver drifted into the opposite lane and collided with a minivan. Eight people, including the elderly driver, were killed and one person was injured.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The danger is real, folks. All sorts of impairments can creep in when a person becomes <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/rights-of-the-elderly\/\"><span style=\"font-weight: 400;\">elderly<\/span><\/a><span style=\"font-weight: 400;\">, and those same impairments can lead to unsafe driving, car accidents, and sometimes death.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">When Should a Senior\u2019s Driving Privileges Be Limited?<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Texas Medical Advisory Board\u2019s <\/span><a href=\"https:\/\/www.dshs.texas.gov\/sites\/default\/files\/medical-advisory-board\/pdf\/MABDriverLimitationGuide.pdf\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Guide for Determining Driver Limitation<\/span><\/i><\/a><span style=\"font-weight: 400;\"> recommends that considerations for licensing of the elderly should include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">General weakness.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Organic brain syndrome that causes memory loss.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Slowed reaction time.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Confusion or psychoses.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Musculoskeletal disabilities.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Loss of visual acuity and peripheral fields.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">It\u2019s tough to limit a senior\u2019s time behind the wheel. Driving is freedom. The ability to drive directly impacts a senior\u2019s quality of life. The Guide acknowledges that attempts should be made to preserve the privilege of driving, as long as the danger to the senior and others is no greater than that of the general population.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It boils down to a question of safety and money. An elderly impaired driver could injure himself or others. He could also be sued for negligence for driving with impaired vision, a history of dizziness, slowed reflexes, or being on medication with a warning not to drive.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The liability doesn\u2019t stop there. You could also be negligent if you loan your vehicle to him knowing he is no longer a safe driver, and he then causes an accident.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">What can be done?<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Driving Qualifications for the Elderly<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.dps.texas.gov\/section\/driver-license\/senior-drivers-age-79-or-older\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Texas Department of Safety<\/span><\/a><span style=\"font-weight: 400;\"> is doing its part. Texas drivers aged 79 or older can only renew their license in person at an authority license renewal station. Drivers aged 85 and older have additional restrictions:\u00a0\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They must renew their license every two years.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pass a vision test.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Provide medical history information.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">How to Approach Driving Restrictions with a Loved One<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You can do your part. In advance of a crisis, you can talk to your dad about signing a Family Driving Agreement. He would agree in writing to designate someone to advise him when it is time to give up the keys. In the best of worlds, your dad\u2019s spouse and all of his children would also sign the agreement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If the time comes when your dad is a danger to himself and others, and you don\u2019t have a Family Driving Agreement, then you may need to have <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/talking-to-your-aging-loved-ones-about-independence\/\"><span style=\"font-weight: 400;\">The Talk<\/span><\/a><span style=\"font-weight: 400;\">.
