{"id":12962,"date":"2024-07-26T06:00:56","date_gmt":"2024-07-26T11:00:56","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=12962"},"modified":"2025-06-18T17:45:15","modified_gmt":"2025-06-18T22:45:15","slug":"marital-agreements-in-texas","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/legal-talk\/marital-agreements-in-texas\/","title":{"rendered":"Thee, Me, and Together Makes Three: Marital Agreements in Texas"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">If the <\/span><i><span style=\"font-weight: 400;\">Siete Partidas<\/span><\/i><span style=\"font-weight: 400;\"> was good enough for Alfonso X, King of Castile from 1252 to 1284, then it should be good enough for Texas.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><i><span style=\"font-weight: 400;\">Siete Partidas<\/span><\/i><span style=\"font-weight: 400;\"> was part of the Castilian law developed during the Reconquest of Spain. It set the foundation for community property laws by giving women certain legal rights to persuade them to move to the villages on the frontier.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Community Property Law in Texas<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Texas law was influenced by the <\/span><i><span style=\"font-weight: 400;\">Siete Partidas<\/span><\/i><span style=\"font-weight: 400;\"> from the very beginning. Texas was an early adopter of <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/community-property-state-rules-explained-who-gets-what\/\"><span style=\"font-weight: 400;\">community property law<\/span><\/a><span style=\"font-weight: 400;\">, which divides marital property into two characterizations:\u00a0 community and separate. Each spouse owns an undivided one-half interest in the community property. Each spouse owns 100% of that spouse\u2019s separate property. The classification of a piece of property is critical to a spouse\u2019s right to certain properties.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Because community property law does not always assure an equitable result, Texas also gives <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/thankful-for-probate-homestead-rights-texas-exemption-protects-widows-children\/\"><span style=\"font-weight: 400;\">widow\u2019s rights<\/span><\/a><span style=\"font-weight: 400;\"> to a person who has lost his or her spouse.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Texas is an outlier. Only eight other states have some form of community property. That means the marital laws of the other 41 states do not work seamlessly with ours.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Community Property Law Agreements<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">To work around that, and other issues, Texas allows couples to agree to modify the effect of community property law on their estate. There are three basic types of agreements:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Premarital agreement\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Partition\/exchange agreement\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Conversion agreement<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">Premarital Agreement<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">In a premarital agreement, the parties can agree to a wide range of matters, such as whether earnings during marriage will be community property, clarifying each party\u2019s right and obligations regarding certain property, limiting or defining obligations upon divorce or death, and defining whether a community estate will arise.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The agreement must be in writing and signed by both parties before marriage. The parties must have the opportunity to receive a fair and reasonable disclosure of the property and debts of the other party before signing. It should be ratified by the parties after their <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/authentic-marriage-vows-hammerle-finley\/\"><span style=\"font-weight: 400;\">marriage<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Partition\/Exchange Agreement<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A partition\/exchange agreement is made after marriage and is used to convert community property into separate property. Spouses can partition or exchange a present or future interest in property, income, and earnings \u2013 which would normally be community property \u2013 into separate property. The agreement must be in writing and signed by both spouses and include specific language that the intent is to convert community property into separate property. Each party must have the opportunity to receive fair and reasonable financial disclosure from the other.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Conversion Agreement<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A conversion agreement is also made after marriage, but for the opposite purpose: to convert separate property into community property. These are most often used in estate planning purposes because community property has certain taxation benefits upon death.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A conversion agreement must be in writing, signed by both spouses, identify the property being converted, and specify that it is being converted into community property.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A word of caution: merely transferring your separate property to the name of your spouse or both of you does not make it community property.
