{"id":12976,"date":"2024-08-18T06:00:24","date_gmt":"2024-08-18T11:00:24","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=12976"},"modified":"2025-06-18T12:19:55","modified_gmt":"2025-06-18T17:19:55","slug":"ladybird-deeds-explained","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/estate-planning\/ladybird-deeds-explained\/","title":{"rendered":"Sing a Song of Land Transfer: Ladybird Deeds Explained"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">There are a nickel\u2019s worth of states who recognize the ladybird deed. <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/aging-in-rural-texas\/\"><span style=\"font-weight: 400;\">Texas<\/span><\/a><span style=\"font-weight: 400;\">, I am happy to report, is one of them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But before I launch into my discussion, I need to give a trigger warning: this column contains legal terminology that may cause you to experience anxiety, light-headedness, and an inexplicable urge to step into your backyard and scream.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What is a Ladybird Deed?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The ladybird deed was originally created under common law, which means someone drafted the first one and then the courts refined the concept through their opinions. They are still refining.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The ladybird deed allows the grantor, who owns the real property, to transfer it to someone else while reserving certain rights. The person on the receiving end of the ladybird deed is called the grantee.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under a ladybird deed, the grantor retains a life estate in the property. That means the grantor can continue to use the property during the grantor\u2019s lifetime. The grantor also retains the <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/your-rights-never-age-resist-power-grab-of-others\/\"><span style=\"font-weight: 400;\">right to sell<\/span><\/a><span style=\"font-weight: 400;\">, mortgage, gift, or otherwise dispose of all or part of the property. If the grantor chooses to exercise those rights, then the grantee receives nothing.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In other words, the grantor can give and then take away, and there is nothing the grantee can do about it. We, lawyers, explain it as follows: the ladybird deed vests the remainder interest in the grantee subject to divestment by the grantor. (That scintillating explanation is why we aren\u2019t invited to many parties.)<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Why is a Ladybird Deed Helpful?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">A ladybird deed can be helpful for a lot of reasons. It can be used to avoid <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/types-of-probate-in-texas\/\"><span style=\"font-weight: 400;\">probate<\/span><\/a><span style=\"font-weight: 400;\"> because the grantee owns the property once the grantor dies.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Medicaid Planning<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">It is often used for <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/medicaid-planning-paying-for-nursing-homes\/\"><span style=\"font-weight: 400;\">Medicaid planning<\/span><\/a><span style=\"font-weight: 400;\"> purposes. Under Texas law, once a person dies the government can ask for reimbursement of the money it paid out under certain types of Medicaid. The government is limited to recovering only what was in that person\u2019s probate estate. So, if the real property passes by a ladybird deed, it does not go into that person\u2019s probate estate, and cannot be used to pay a Medicaid reimbursement claim.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Avoid an Affidavit of Heirship<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">It can be used to avoid filing an <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/affidavit-of-heirship-what-is-it\/\"><span style=\"font-weight: 400;\">affidavit of heirship<\/span><\/a><span style=\"font-weight: 400;\"> in the public record. The affidavit is a common way to show that title of land passed to the heirs when the grantor did not leave a will.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Flexibility<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A ladybird deed can also contain a warranty of title. This provides flexibility to the grantor.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">The Downsides of a Ladybird Deed<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Not all is sunshine and birdsong with a ladybird deed. A married couple, for example, may run into difficulties if they both sign as grantors on a ladybird deed. In a 2023 opinion, husband and wife both signed as grantors on a ladybird deed regarding the family home and 10 acres. The grantee was a third person. Husband died. His <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/this-is-what-you-need-to-know-before-signing-a-will\/\"><span style=\"font-weight: 400;\">will<\/span><\/a><span style=\"font-weight: 400;\"> left everything to his wife. The wife, through her power of attorney agent, then signed a document revoking the ladybird deed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The grantee argued that the wife couldn\u2019t do that because he received the husband\u2019s one-half interest in the property upon the husband\u2019s death. The Court agreed, and the grantee ended up owning an undivided interest in the house and land.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Ladybird Deed vs. Transfer on Death Deed<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A ladybird deed is different from a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/understanding-transfer-on-death-deeds-texas\/\"><span style=\"font-weight: 400;\">transfer on death deed<\/span><\/a><span style=\"font-weight: 400;\">, which only vests title in the grantee when the grantor dies. The grantee on the TOD deed must survive the grantor by 120 hours.
