Instead, this column will be devoted to a lighthearted topic: deeds and why their wording matters.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Community Property vs. Separate Property in Texas<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Texas, you see, is a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/community-property-state-rules-explained-who-gets-what\/\"><span style=\"font-weight: 400;\">community property state<\/span><\/a><span style=\"font-weight: 400;\">. When you are married, your real property is characterized as either community or separate. Property acquired during marriage is presumed to be community property. Property acquired before marriage, by gift, or by inheritance is presumed to be separate property.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a divorce, the court can divide the community property, but a spouse usually gets to keep his or her separate property. Thus, the spouse has a huge incentive to prove property is separate property.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s see how that plays out with a notoriously tricky document: the deed.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Gifting Separate Property<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Brenda and Frank Raymond were married on June 20, 1987. Before marrying, Frank had purchased a lot in Lake Jackson, Texas. That made it Frank\u2019s separate property.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After marriage, at Brenda\u2019s urging, Frank executed a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/real-estate\/6-types-of-real-estate-deeds-to-know-about\/\"><span style=\"font-weight: 400;\">deed<\/span><\/a><span style=\"font-weight: 400;\"> conveying an undivided one-half interest in the property to her.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Then they divorced. Frank claimed that he never intended for Brenda to have an interest in the Lake Jackson property. Not so, said the Court. The deed he signed to Brenda was a gift. A gift is separate property. When they divorced, Frank owned an undivided \u00bd interest in the Lake Jackson lot as his separate property, and Brenda owned an undivided \u00bd interest as her separate property.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Community Property and Marriage<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Acquiring vs. Gifting<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Let\u2019s move on to Anthony and Victoria Ustanik. They were married on July 17, 2010. After marriage, Anthony acquired a property in Alvarado, Texas from his parents. The deed recited \u201cAnthony Ustanik, a Married Person\u201d as the grantee.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Anthony and Victoria then filed for divorce. Anthony claimed the property was a gift to him from his parents, and therefore his separate property.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Not so, said the Court. The property was acquired during marriage and was presumed to be community property. Anthony had to overcome that presumption. While he claimed the property was a gift, the language in the deed recited that the property was conveyed to Anthony for consideration of $10.00 \u201cand other good and valuable consideration.\u201d That is not the language for a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/intentional-gifting\/\"><span style=\"font-weight: 400;\">gift<\/span><\/a><span style=\"font-weight: 400;\">. A gift is a voluntary transfer of property made gratuitously and without consideration.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Acquiring Property While Married<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">That brings us to Michael and Lexi Nash. They were married on August 6, 1997. Between 2000 and 2011, Michael purchased several properties that were deeded just to him.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Then they <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/protecting-your-assets-in-a-divorce\/\"><span style=\"font-weight: 400;\">divorced<\/span><\/a><span style=\"font-weight: 400;\">. Michael claimed those properties were his separate property.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One was the Grubbs property. Michael had signed the contract to purchase the property, the loan was solely in his name, and the deed was in his name. The Court found it was community property because it was purchased during marriage.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another property was the Loop and 59 Tract. It was deeded only to Michael, and the loan was solely in his name. Both Lexi and Michael signed the deed of trust securing the loan. The Court found it was Michael\u2019s separate property.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Why the difference? Because the deed recited it was conveyed to Michael, \u201ca married man, as his sole and separate property and not joined in\u2026by his spouse\u2026\u201d That negated the community property presumption.
