She addressed the issue of one spouse making the other an authorized user on their credit card and opined that only the person who opened the account is liable for the credit card debt.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">She obviously is not from Texas.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Great State of Texas is a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/community-property-state-rules-explained-who-gets-what\/\"><span style=\"font-weight: 400;\">community property state<\/span><\/a><span style=\"font-weight: 400;\">. We have our own take on spouses, liability, and satisfaction of a judgment.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">How Does Community Property Work?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Here is how it works. We\u2019ll take an imaginary married couple \u2013 Ernest and Mary \u2013 and walk through the law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ernest opens a credit card in his name. He designates Mary as an authorized signer on the card.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mary charges $20,000 on the card. Neither Ernest nor Mary have enough money to pay the charge, and they default.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The credit card company sues Ernest, the account holder.\u00a0 It cannot sue Mary because she did not sign the contract with them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This tracks with the business columnist\u2019s advice. As far as the credit card company is concerned for its lawsuit, only Ernest is liable for the debt.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The credit card company gets a judgment and proceeds with collection. Now the columnist\u2019s advice becomes misleading.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Defining Separate Property vs. Community Property<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The credit card company can collect from Ernest\u2019s <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/community-property-separate-property-deed\/\"><span style=\"font-weight: 400;\">separate property<\/span><\/a><span style=\"font-weight: 400;\">. That is property owned by Ernest before marriage, is acquired as a gift, or is an inheritance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It can also be collected from the community property owned by Ernest and Mary. And everything Ernest and Mary own is presumed, by law, to be community property.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That means the credit card company can, in good faith, proceed against all of Mary and Ernest\u2019s non-exempt assets to pay the judgment against Ernest.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Notice I threw in the qualifier \u201cnon-exempt.\u201d That is because Texas law makes certain assets exempt from collection. That, however, is a topic for another column.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Collecting from Community Property<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Let\u2019s dive a bit more into the weeds regarding community property and collectability. Community property is divided into three categories:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Community property is subject to Ernest\u2019s sole management, control, and disposition.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Community property is subject to <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/legal-talk\/marital-agreements-in-texas\/\"><span style=\"font-weight: 400;\">joint management<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Community property is subject to Mary\u2019s sole management, control, and disposition.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Sole management community property is the property the person would have owned if he or she was single. That includes:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Personal earnings.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Revenue from separate property.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Recoveries for personal injury.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">And the increases and mutations of, and the revenue from, all property subject to the spouse\u2019s sole management community property.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">That is important because one spouse\u2019s sole management community property cannot be reached to pay the other spouse\u2019s debts. So, the credit card company would usually not be able to reach Mary\u2019s sole management community property or her separate property.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, Mary incurred the debt. That leaves an argument that Mary\u2019s sole management community property and her separate property could be reached by the credit card company.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Importance of Sole Management Community Property<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You can see the problem. Few couples keep records to support a claim of sole management community property. Fewer keep separate property separate. And even fewer <\/span><a href=\"https:\/\/hammerle.com\/our-team\/\"><span style=\"font-weight: 400;\">hire a lawyer<\/span><\/a><span style=\"font-weight: 400;\"> to defend them in a collection action and raise these technical defenses.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When a defense to collection is raised, then is up to the judge to determine the order of which property is subject to \u201cexecution,\u201d or payment of the judgment.
