{"id":13031,"date":"2024-12-01T06:00:59","date_gmt":"2024-12-01T12:00:59","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=13031"},"modified":"2025-06-18T12:10:04","modified_gmt":"2025-06-18T17:10:04","slug":"premises-liability-doctorine-of-common-conditions","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/legal-talk\/premises-liability-doctorine-of-common-conditions\/","title":{"rendered":"The $6 Million Judgement That Wasn\u2019t: How the Doctrine of Common Conditions Saved the Watermelons and Your Couch"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Watermelons do not usually lend themselves to $6 million judgments. These did, and incidentally led to a bit of law that you need to know about.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the <\/span><a href=\"https:\/\/www.txcourts.gov\/supreme\/orders-opinions\/2024\/june\/june-14-2024\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Texas Supreme Court\u2019s opinion<\/span><\/a><span style=\"font-weight: 400;\">, it all started when Roel Canales was in a grocery store and approached a display of whole watermelons on a wooden pallet. He was wearing steel-toed work boots and did not realize that he had placed his foot in the pallet\u2019s open side. As he stepped away, \u201chis toe got caught, and he fell and fractured his right elbow.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mr. Canales sued the owner of the grocery store, Pay and Save. The jury awarded him $6 million.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Supreme Court overturned it.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Understanding Premises Liability<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The issue concerned premises liability, a cause of action that is brought by an invitee (someone, like a customer or house guest, who is invited onto the premises) against a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/business-law\/8-questions-small-business-owners-should-ask-their-attorney\/\"><span style=\"font-weight: 400;\">premises owner<\/span><\/a><span style=\"font-weight: 400;\">. One of the things an invitee must show to prevail on a premises liability claim is that the premises owner had actual or constructive knowledge of an unreasonably dangerous condition on the premises.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That is a lot to unpack, but the Court focused on just one element: was the wooden pallet holding the watermelons unreasonably dangerous as a matter of law?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Enter the \u201cdoctrine of common conditions.\u201d That doctrine provides that just because a condition causes an injury, that does not make it unreasonably dangerous.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What is the Doctrine of Common Conditions?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Suppose your houseguest stubs his toe on a couch you placed against a wall in your home. The doctrine of common conditions would hold that your couch is not an unreasonably dangerous condition just because your houseguest suffered an <\/span><a href=\"https:\/\/hammerle.com\/practice-areas\/litigation-lawyers\/personal-injury\/\"><span style=\"font-weight: 400;\">injury<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Thank goodness. Without this doctrine, your house and everything in and around it could be characterized as unreasonably dangerous. Without this doctrine, it could be argued that you could always have taken \u201cjust one more step\u201d to prevent an injury.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The upshot is that you are not an insurer of a visitor\u2019s safety. You are not required to make your premises foolproof. You do not have to bubble-wrap your couch.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The court put it this way: \u201cIn short, the mere possibility of harm that accompanies every condition in existence provides no basis for a tort claim.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Thus, an invitee-plaintiff must show more than a mere possibility of harm in an existing condition.\u00a0 Mr. Canales of the watermelon case did not. In South Texas, the use of wooden pallets to transport and display whole watermelons is common. Although thousands of people have walked past such pallets, there was no evidence of prior complaints, reports, or injuries about the type of pallet that held the watermelons. There was no law restricting the use of pallets in such a manner.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Just like placing a couch against the wall in your house is a common practice and not forbidden by any law.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">The Law and a Modicum of Common Sense<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Could there be a safer alternative to using a pallet for watermelons? Sure. But that does not mean that the store owner knew that the pallet was unreasonably dangerous.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The law contemplates that we will exercise a modicum of common sense, prudence, and caution when we encounter a common condition like a pallet holding watermelons. The court held that Mr. Canales, in his own words, failed to use those faculties: \u201cI wasn\u2019t looking at the floor.\u00a0 I don\u2019t go in looking at my feet or where the hazards are.
