{"id":13044,"date":"2024-12-27T06:00:53","date_gmt":"2024-12-27T12:00:53","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=13044"},"modified":"2025-06-18T12:07:45","modified_gmt":"2025-06-18T17:07:45","slug":"2024-court-decisions","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/legal-talk\/2024-court-decisions\/","title":{"rendered":"A Slightly Myopic View of 2024 Court Decisions Affecting Seniors"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Every year Texas appellate courts issue hundreds of decisions, some interesting and others frankly boring. This is my summary of the interesting decisions I thought worth highlighting.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Interesting Court Decisions of 2024<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Attorney Testimonies<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Testimony by an attorney can be considered as evidence even if the attorney is not sworn as a witness. In that case, the attorney, who was appointed as a guardian ad litem, was deemed an officer of the court and therefore already under a duty to tell the truth.\u00a0 Besides, no one objected to the failure to swear in the attorney.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Right to a Jury Trial<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">There is no statutory right to a jury trial for a trust modification proceeding. This case was far-reaching because the court\u2019s reasoning was broad and could be used to bar jury trials for other causes of action.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Probate<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If a will was <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/types-of-probate-in-texas\/\"><span style=\"font-weight: 400;\">probated<\/span><\/a><span style=\"font-weight: 400;\"> as a muniment of title prior to September 1, 2019, that case cannot be reopened to allow for regular administration. This decision was bad news for older muniment of title cases.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Parental Rights\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">While <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/parent-child-relationship-lasts-for-eternity\/\"><span style=\"font-weight: 400;\">parents<\/span><\/a><span style=\"font-weight: 400;\"> have a fundamental right to make decisions for their minor children, that right is not absolute. According to the Texas Supreme Court, the state has the authority to regulate medical treatment for children. The case upheld the Texas law prohibiting medical treatments for children related to gender transitioning.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Divorce Cases<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">In a case where the court announced a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/tips-to-make-your-divorce-flow-more-smoothly\/\"><span style=\"font-weight: 400;\">divorce<\/span><\/a><span style=\"font-weight: 400;\"> in open court but did not specify the grounds, property division, or file a written decree before one of the parties died, the court lacked jurisdiction to file the written decree after death. In other words, although the court pronounced them divorced, the parties were still married when one of them died.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Court of Appeals<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The new 15<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> Court of Appeals, which has exclusive appellate jurisdiction over certain civil matters involving the state of Texas and its agencies, and appeals from the <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/business-law\/the-88th-texas-legislature-delivers-for-business-with-asset-protection-and-new-specialized-courts\/\"><span style=\"font-weight: 400;\">Texas business courts<\/span><\/a><span style=\"font-weight: 400;\">, is constitutional.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Mental Anguish Damages<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If you sue for mental anguish damages, then your mental health records become discoverable. You cannot hide behind <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/mental-health-and-guardianship\/\"><span style=\"font-weight: 400;\">mental health<\/span><\/a><span style=\"font-weight: 400;\"> and patient-doctor privileges.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Property Owner Liability<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A property owner is generally not responsible for someone\u2019s safety after they leave the property and are injured on a nearby public property.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Court Deference to Governmental Agencies<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">No summary would be complete without mentioning a major U.S. Supreme Court decision: <\/span><a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-451_7m58.pdf\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Loper Bright Enterprises v. Raimondo<\/span><\/i><\/a><span style=\"font-weight: 400;\">. This decision removed the courts\u2019 deference to governmental agencies in interpreting rules. Further, it held that an agency action must be authorized by statute to be valid. The reaction was prompt: a multitude of agency actions have already been challenged.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Generative Artificial Intelligence<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Courts everywhere wrestled with the use of Generative Artificial Intelligence (\u201cGAI\u201d) by attorneys. The problem is that GAI is unreliable: when it does not know an answer, then it often just makes one up. This has happened so often that is referred to as the \u201challucination\u201d of cases.\u00a0 GAI also has an unfortunate track record of conjuring up fake statutes, misciting sources, and drawing erroneous legal conclusions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After several cases where courts sanctioned lawyers for using GAI-generated pleadings and excluded experts for relying on GAI to create their reports, the Courts responded by issuing standing orders and local rules on using GAI in their Courtrooms. These run the gamut from making attorneys aver on each pleading whether or not GAI was used to requiring attorneys to take extra steps to personally check all sources.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Prepare for 2025 with Hammerle Morris Law Firm<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">While 2024 was eventful, we expect 2025 to eclipse it because the Texas legislature is meeting and Republicans are taking control of the Federal executive and legislative branches.
