{"id":13062,"date":"2025-02-09T06:00:33","date_gmt":"2025-02-09T12:00:33","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=13062"},"modified":"2025-06-18T12:03:16","modified_gmt":"2025-06-18T17:03:16","slug":"asset-protection-and-nursing-homes","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/estate-planning\/asset-protection-and-nursing-homes\/","title":{"rendered":"Asset Protection and Nursing Homes: Early Planning a Must"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">You are sitting around the kitchen table with family and sometime between dinner and your dessert course of Blue Bell ice cream, the issue of paying for nursing homes comes up.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">First, it is wonderful that you and your family are thinking about this before it becomes a crisis.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Second, a general discussion is nice but you will not be able to come up with a plan without looking at your specific facts and then applying the law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s look at the main questions to get you started.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Questions to Ask When Considering a Nursing Home<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">1. Are you married?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If so, then you need to do a deep dive into whether your <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/community-property-separate-property-deed\/\"><span style=\"font-weight: 400;\">property<\/span><\/a><span style=\"font-weight: 400;\"> is:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Separate<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sole management community property<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Joint management community property<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Exempt or non-exempt.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Start with a list of assets and debts and go from there. This is a complicated analysis, so you may want to discuss it with an attorney. The goal is to determine what assets can be reached if you end up owing a nursing home money, before and after your death. Nursing home debt is considered a necessary obligation, and that means your spouse\u2019s assets can be held liable to pay it. You and your spouse should be worried.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">2. Do you have long-term care insurance?\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If so, pull out the policy and look at what triggers payment and what will be covered. Remember that insurance companies are highly motivated \u2013 both to take your money and to find a reason not to pay it out. Their procedures to successfully file a claim can be onerous. You can start compiling information now so it will be easier when the time comes.<\/span><\/p>\n<h4><span style=\"font-weight: 400;\">Medicaid as an Alternative<\/span><\/h4>\n<p><span style=\"font-weight: 400;\">If you think you cannot afford to private pay for a nursing home, then you need to consider <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/legal-talk\/checklist-for-2025\/\"><span style=\"font-weight: 400;\">Medicaid<\/span><\/a><span style=\"font-weight: 400;\">. That is a state-federal program that provides government assistance to pay for nursing-home level care. You probably want to start looking at Medicaid planning. You do not want to take a misstep, such as gifting property or selling your homestead, that would delay your qualification. There is a five-year lookback for such transactions.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As for protecting your assets from a Medicaid claim after you die, you will want to meet with an <\/span><a href=\"https:\/\/hammerle.com\/practice-areas\/estate-planning-probate\/estate-planning\/\"><span style=\"font-weight: 400;\">estate planning attorney<\/span><\/a><span style=\"font-weight: 400;\">. In Texas, it is called a MERP claim and can only be asserted against your probate estate. You may be able to protect your home and other assets through careful planning.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">3. Are you the beneficiary of an irrevocable trust?\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If so, then pull out the <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/never-say-never-can-you-revoke-an-irrevocable-trust\/\"><span style=\"font-weight: 400;\">trust document<\/span><\/a><span style=\"font-weight: 400;\"> and consider if the trustee has the authority, and assets, to pay for your nursing home care.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">4. Have you seen a nursing home contract?\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If not, then contact a good nursing home and ask if you can review their contract. Be aware that nursing home contracts can be tricky. Although a nursing home is prohibited by law from requiring a guarantee on its nursing home contracts, it often has admission and billing policies that look like financial guarantees and allow the nursing home to hold a third party \u2013 friend, family member, or associate \u2013 financially responsible. There is CMS guidance, reference <\/span><a href=\"https:\/\/www.cms.gov\/files\/document\/qso-25-12-nh.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">QSO-25-12-NH<\/span><\/a><span style=\"font-weight: 400;\">, prohibiting these types of provisions. It is slated to take effect on March 24, 2025, but that could change.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">5. Do you have a revocable trust that you have funded with assets?\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If so, then you should consider that the assets in the <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/funding-of-revocable-living-trusts\/\"><span style=\"font-weight: 400;\">trust<\/span><\/a><span style=\"font-weight: 400;\"> are not protected from your creditors during your lifetime.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Hammerle Morris is Here to Help With Adult Guardianship<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Nursing homes are expensive.
