She did some internet research on the computer about how <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/community-property-separate-property-deed\/\"><span style=\"font-weight: 400;\">community property<\/span><\/a><span style=\"font-weight: 400;\"> was handled in a divorce and was happy to learn that it would be divided equally. Imagine her surprise when the Judge awarded her only 40%, which was considerably less than an equal division.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mary had been duped by AI.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What is Artificial Intelligence (AI)?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Artificial intelligence, commonly known as AI, is everywhere. It shows up in online searches. It creates summaries. It drafts papers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Google has a version on its search engine called \u201cGenerative AI\u201d which, by its own definition is a \u201ctype of artificial intelligence that can create new content\u2026. based on patterns it learns from existing data\u2026\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you type a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/10-most-common-estate-planning-questions\/\"><span style=\"font-weight: 400;\">legal question<\/span><\/a><span style=\"font-weight: 400;\"> into the Google search function, then Generative AI is all too ready to answer.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That is not a good thing.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Legal Questions Yield Questionable Answers<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">During my research for this column, when I typed in a search for \u201cwhat is community property,\u201d the answer popped up at the top of the page under the heading \u201cAI Overview.\u201d There, for all to see, was the statement \u201cCommunity property is divided equally between spouses during a divorce or legal separation.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nice information, but it is wrong in Texas. <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/legal-talk\/yours-mine-and-ours-texas-community-property-explained\/\"><span style=\"font-weight: 400;\">Texas<\/span><\/a><span style=\"font-weight: 400;\"> requires that the property be divided equitably, which does not necessarily mean a 50-50 split.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lawyers get duped by AI, too. They have been caught citing fake cases and summarizing fake laws, all created by AI tools.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Lawyers vs. AI<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">In one case, a New York lawyer found himself handling a case in federal court. He did not have the experience to handle the issues that were being raised and did not have subscriptions to the usual legal research tools. He turned to the internet site ChatGPT for his research.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The resulting responsive pleading, which the lawyer\u2019s law firm colleague filed without review, cited phony cases with bogus quotes. When the Judge asked them to explain, the lawyers doubled down and filed an affidavit that included the ChatGPT summaries instead of any actual case decisions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Judge was not amused. He sanctioned the lawyers and their law firm.\u00a0\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Why is Artificial Intelligence Unreliable?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">One of the reasons that AI answers are unreliable is what they use to \u201clearn\u201d how to respond. AI relies on \u201cpatterns from existing data.\u201d If the existing data is wrong or incomplete, then the answer is going to be wrong or incomplete.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">AI seems to use sources that are readily available on the Internet for its answers. When I typed in a prompt, the responses showed a link symbol in blue for its source. Not all the sources it showed are considered authoritative by lawyers and judges; many seemed to be just marketing materials.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">The Specificity of the Search Determines the Answer<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Another problem: the AI answer given is a result of the prompt that is typed into the search bar.\u00a0 The more specific the prompt, the more specific the answer. When I changed my prompt to \u201cwhat is community property in Texas\u201d the statement that came up was \u201ccommunity property is usually split equally between the spouses.\u201d\u00a0 That was better, but still incomplete. Only when I narrowed my prompt to \u201chow is community property divided in a Texas <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/tips-to-make-your-divorce-flow-more-smoothly\/\"><span style=\"font-weight: 400;\">divorce<\/span><\/a><span style=\"font-weight: 400;\">\u201d did AI give me a decent response.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Get Your Questions Answered with Hammerle Morris, Not AI<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">My last prompt was \u201ccan Generative AI be relied upon.\u201d The answer I received was \u201cAn AI Overview is not available for this search.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When it does give an AI Overview, Google notes in smaller print at the bottom \u201cGenerative AI is experimental.
