{"id":13069,"date":"2025-02-21T06:00:56","date_gmt":"2025-02-21T12:00:56","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=13069"},"modified":"2025-06-18T12:01:20","modified_gmt":"2025-06-18T17:01:20","slug":"disclaiming-inheritance","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/probate\/disclaiming-inheritance\/","title":{"rendered":"The Result of Disclaiming an Inheritance Might Surprise You"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Not all inheritances are welcome.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Suppose you have a judgment against you for $100,000, and your Aunt Debbie dies and leaves you $50,000 in her will.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you accept your <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/great-wealth-transfer-inheritance-may-be-coming-your-way\/\"><span style=\"font-weight: 400;\">inheritance<\/span><\/a><span style=\"font-weight: 400;\">, then your judgment creditor could take the entire amount and apply it against the $100,000 judgment against you. Not surprisingly, you think that is a bad idea.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">What can you do? One idea is to disclaim your inheritance.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Understanding Disclaiming Inheritance<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">A disclaimer means that you refuse to accept an interest in, or power over, property. It applies to property passing as a result of a host of other mechanisms and:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Inheritance<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Will<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/community-property-survivorship-agreements-this-tool-deserves-another-look\/\"><span style=\"font-weight: 400;\">Survivorship agreement<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Insurance<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Annuity<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/retirement-plans-complicated-secure-act-secure-2-0-act-not-help\/\"><span style=\"font-weight: 400;\">Retirement plan<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contract\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">If you disclaim the $50,000, then where will the money go? An effective disclaimer will act as though you died before your Aunt. The amount disclaimed vests in your descendants, meaning that your children will receive the $50,000 that was originally left to you.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As a result, your judgment creditor is left without. And because an effective disclaimer means you never accepted an interest in the $50,000, your creditor cannot attack it as a fraudulent conveyance.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">When are Disclaimers Ineffective?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Disclaimers do not work in every situation. For example:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You cannot accept any part of the $50,000 if you want to disclaim the entire amount.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You cannot have voluntarily assigned, conveyed, encumbered, pledged, or transferred the $50,000.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the $100,000 judgment was for child support, then a disclaimer is not effective.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If you sign a written waiver of your right to disclaim, then you cannot later disclaim.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A disclaimer cannot defeat a federal tax lien or a claim in a pending bankruptcy.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">So much for Texas law: you can also follow certain procedures and make the disclaimer \u201cqualified\u201d under the Internal Revenue Code. That means the <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/irs-issues-alerts-on-common-law-trust-and-dozen-scams\/\"><span style=\"font-weight: 400;\">IRS<\/span><\/a><span style=\"font-weight: 400;\"> will treat the $50,000 as if you had never received it.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Different Ways to Use a Disclaimer<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Tax-Planning Tool<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Disclaimers can be used as a tax-planning tool. It is a common tactic when a surviving spouse wants to take advantage of the deceased spouse\u2019s applicable tax-planning tool.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If that last sentence sounded like gibberish, then ask your friendly tax attorney to explain.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">As a Trustee<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Disclaimers are not just available to individuals. Trustees can disclaim an interest in property that otherwise would have become trust property. A holder can disclaim a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/hot-powers-for-the-masses-a-useful-tool-that-should-be-used-carefully\/\"><span style=\"font-weight: 400;\">power of appointment<\/span><\/a><span style=\"font-weight: 400;\">. A fiduciary can disclaim a power that he would otherwise have been given.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Common Questions About Disclaimers<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Is it Simple to Make a Disclaimer?\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Yes. Is it simple to make an effective, qualified disclaimer? No.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, <\/span><a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/PR\/htm\/PR.240.htm#240\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Chapter 240, Subchapter 6 of the Texas Property Code<\/span><\/a><span style=\"font-weight: 400;\">, has 11 sections that describe how and to whom different types of disclaimers must be delivered. If it is not properly delivered, then a disclaimer is ineffective.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">When Do You Need to Make Your Disclaimer?<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Here is a place with the Tax Code and Texas law differ.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you are making the disclaimer under the tax code to avoid gift tax, then it must be made within nine months after Aunt Debbie\u2019s death, or within nine months after a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/funding-of-revocable-living-trusts\/\"><span style=\"font-weight: 400;\">revocable<\/span><\/a><span style=\"font-weight: 400;\"> transfer becomes irrevocable. If your disclaimer is merely under Texas law, then there is no deadline, with an important caveat:\u00a0 if you wait too long, then you may do something that makes disclaiming the interest impossible.
