The powers you give your agent are spelled out in the document. Most agents are given extensive powers \u2013 everything from selling your land to making investment decisions. Some are given \u201chot powers\u201d that include setting up and funding a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/funding-of-revocable-living-trusts\/\"><span style=\"font-weight: 400;\">revocable trust<\/span><\/a><span style=\"font-weight: 400;\"> in your name.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In Texas, durable powers of attorney are authorized by statute. The statute helpfully describes the extent of the powers and other duties of your agent.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Texas Statute Gives a Roadmap on Suing<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">That is why durable powers of attorney can lead to big litigation. One statute in particular \u2013 <\/span><a href=\"https:\/\/statutes.capitol.texas.gov\/docs\/es\/htm\/es.751.htm\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Estates Code Section 751.251<\/span><\/a><span style=\"font-weight: 400;\"> &#8211; gives a lot of people the right to file suit about your durable power of attorney.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Who Can Sue?<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Your agent.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Texas Department of Family and Protective Services.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Your <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/procedure-for-simple-guardianship\/\"><span style=\"font-weight: 400;\">guardian<\/span><\/a><span style=\"font-weight: 400;\">, if you have one.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Anyone named as a beneficiary to receive property upon your death.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Any person who \u201cdemonstrates to the court sufficient interest\u201d in your welfare or estate.\u00a0\u00a0\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Let\u2019s see. That could cover your spouse, children, grandchildren, neighbors, and maybe an ex-spouse or two. And, of course, the State of Texas.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">What Can They Sue About?\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Construing your durable power of attorney, determining its validity or enforceability, and reviewing your agent\u2019s conduct under your durable power of attorney.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">What Can the Court Order After Someone Files a Suit Under 751.251?\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">It can order your <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/choosing-your-financial-or-medical-agent\/\"><span style=\"font-weight: 400;\">agent<\/span><\/a><span style=\"font-weight: 400;\"> to account for his or her actions, appoint another party to take possession of your property and administer it, compel the agent to pay money or restore your property, compel the agent to perform his or her duties, suspend or remove your agent, void an act of your agent, impose a constructive trust or lien on property\u2026you get the picture.\u00a0\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Other Things to Consider With a Durable Power of Attorney<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">751.251 does not give someone an unlimited license to kill your durable power of attorney. You, as principal, can file a motion to dismiss the lawsuit, and the court has to grant it unless the court finds that you lack the capacity to revoke your agent\u2019s authority or the <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/5-important-steps-for-durable-power-of-attorney-agent\/\"><span style=\"font-weight: 400;\">power of attorney<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Further, the statute contains a huge disincentive: money. The court can award costs and reasonable and necessary attorneys\u2019 fees in an amount considered equitable and just. That means the person filing the lawsuit could end up paying all of the attorneys\u2019 fees in the case.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Now let\u2019s go to an example, loosely based on a real case.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Texas Durable Power of Attorney at Work<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Mom and Dad have two children. They signed a joint revocable living trust, leaving their estate to their children. Mom signed a durable power of attorney naming Dad as her agent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mom then became incapacitated.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dad got busy. He amended the revocable trust to change how it would be distributed, and, in the process, left a lot less to the two children. Importantly, Dad used his power as Mom\u2019s agent to sign the amendment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dad then became incapacitated. The successor <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/review-will-and-trust\/\"><span style=\"font-weight: 400;\">trustee<\/span><\/a><span style=\"font-weight: 400;\"> took over the trust.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The two children sued the successor trustee under 751.251, asking the court to construe Mom\u2019s durable power of attorney and find that it did not give Dad authority to amend the trust as Mom\u2019s agent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Court looked at the specific wording of Mom\u2019s durable power of attorney and decided Dad had the power to amend the trust but could not change the distribution plan. Thus, the two children received the entire trust estate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An example of 751.251 in action.
