Or Not?"},"content":{"rendered":"<h2><span style=\"font-weight: 400;\">Differences Among Texas Statutes Confusing<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Texas statutes are proudly laid out in an orderly sequence. Laws about families are found in the <\/span><a href=\"https:\/\/statutes.capitol.texas.gov\/docs\/sdocs\/familycode.pdf\"><span style=\"font-weight: 400;\">Family Code<\/span><\/a><span style=\"font-weight: 400;\">, laws about guardianship, <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/black-hole-of-probate\/\"><span style=\"font-weight: 400;\">probates<\/span><\/a><span style=\"font-weight: 400;\">, and inheritance reside in the Estates Code, and laws about things such as birth certificates can be found nestled within the Health &amp; Safety Code.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Helpfully, each one of these codes contains definitions, too.\u00a0 The trouble is that those definitions \u2013 and by extension the statutes \u2013 do not always agree. Take the concept of \u201c<\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/fatherhood-by-the-book-law-and-biology-not-always-the-same\/\"><span style=\"font-weight: 400;\">father<\/span><\/a><span style=\"font-weight: 400;\">.\u201d Are you one? Let\u2019s see what Texas law has to say about that.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What the Family Code Says<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Five Legal Pathways to Fatherhood<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The Family Code gives a man five chances to be a parent. A father might be interested in these definitions because they control his rights to possess and have a say in decisions regarding the child, his duties and responsibilities regarding the child, and his obligation to pay support for the child.<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Presumed father &#8211; Typically applies if the man is married to the child\u2019s mother at the time of birth or conception.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Legally determined father &#8211; Established through genetic testing or another legal process.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Adjudicated father &#8211; Declared by a court in a legal proceeding.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Acknowledged father &#8211; Has signed a legal acknowledgement of paternity.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Adoptive father &#8211; Has legally adopted the child.<\/span><\/li>\n<\/ol>\n<h3><span style=\"font-weight: 400;\">Termination of Parental Rights<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Importantly, if a man\u2019s parent-child relationship has been terminated by court order, the Family Code no longer considers him a father, even if he met one of the five criteria before.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">How the Estates Code Defines a Father<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Three Definitions for Guardianship Purposes<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The Estates Code takes a slightly different approach when it defines \u201cparent\u201d for <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/what-is-guardianship-of-the-person\/\"><span style=\"font-weight: 400;\">guardianship <\/span><\/a><span style=\"font-weight: 400;\">purposes. It gives a man only three chances at the title and focuses more on the biological aspect.\u00a0<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A man who is presumed to be the biological father of a child.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A man who has been adjudicated to be the biological father of a child by a court of competent jurisdiction.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A man who is the adoptive father of a child.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">And, like the Family Code, a man who has had his <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/parent-child-relationship-lasts-for-eternity\/\"><span style=\"font-weight: 400;\">parent-child relationship<\/span><\/a><span style=\"font-weight: 400;\"> terminated is knocked out of the running.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Inheritance and the Biological Father<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">When Can a Father Inherit from a Child\u2013and Vice Versa?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">For <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/great-wealth-transfer-inheritance-may-be-coming-your-way\/\"><span style=\"font-weight: 400;\">inheritance<\/span><\/a><span style=\"font-weight: 400;\"> purposes, the Estates Code mostly borrows from the Family Code, creating even more complexity. A biological father can inherit from a child (and the child from him) only if:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">There\u2019s an unrebutted presumption of paternity<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">He has acknowledged paternity<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A court adjudicated him as the father<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">He adopted the child<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">He consented to assisted reproduction by his wife, resulting in the child\u2019s birth<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">Exception: Termination Orders<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If a father\u2019s parental rights to his child have been terminated, then usually the father cannot inherit from the child, but the child can still inherit from the father. But &#8211; it depends on the wording in the termination order.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Birth Certificates and the Health &amp; Safety Code<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">How the Father Gets on the Birth Certificate<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Not to be outdone, the Health &amp; Safety Code defines \u201cfather\u201d for purposes of the baby\u2019s birth certificate.
