{"id":13165,"date":"2025-06-22T06:00:41","date_gmt":"2025-06-22T11:00:41","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=13165"},"modified":"2025-06-24T09:16:35","modified_gmt":"2025-06-24T14:16:35","slug":"the-89th-texas-legislature-produces-some-wins-for-seniors","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/legal-talk\/the-89th-texas-legislature-produces-some-wins-for-seniors\/","title":{"rendered":"The 89th Texas Legislature Produces Some Wins for Seniors"},"content":{"rendered":"<h2><span style=\"font-weight: 400;\">Texas Legislative Session by the Numbers<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Texas Legislature completed the 89<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> regular session with impressive volume:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a08,719 bills filed<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">1,210 sent to the Governor<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">As of June 12, 2025, the Governor had signed 370 bills, allowed 24 bills to take effect without his signature, and vetoed 2 bills.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">New Laws Seniors Should Pay Attention To<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">For Texas lawyers, keeping up with legal changes is no easy task\u2014it\u2019s like trying to stop Bubba from drinking that one last beer. While we can\u2019t cover every new law, this post highlights a few lesser-known bills that could have a significant impact on seniors, particularly in areas such as <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/real-estate\/using-a-real-estate-attorney-to-buy-a-house\/\"><span style=\"font-weight: 400;\">real estate<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/black-hole-of-probate\/\"><span style=\"font-weight: 400;\">probate<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/adult-guardianship\/what-is-guardianship-of-the-person\/\"><span style=\"font-weight: 400;\">guardianship<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/healthcare-experts-and-the-law\/\"><span style=\"font-weight: 400;\">healthcare<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">SB 693: Criminal Charges for Improper Notarization &#8211; Effective 9\/1\/2025<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Those of us in the real estate, probate, and guardianship fields have seen a growing problem with notaries on <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/real-estate\/6-types-of-real-estate-deeds-to-know-about\/\"><span style=\"font-weight: 400;\">deeds<\/span><\/a><span style=\"font-weight: 400;\">, wills, and powers of attorney. SB 693 addresses this by:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Making it a Class A misdemeanor offense for a notary public who performs a notarization for a person who did not personally appear before the notary at the time the notarization is executed.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The offense is an entrance to a state jail felony if the notarized document involves a deed or transfer of an interest in real property.\u00a0\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Online notarization is still permitted, provided the Texas statutory requirements are followed.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">HB 1041: Preventing Life Insurance Fraud by Caregivers &#8211; Effective 5\/29\/2025<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">To combat financial exploitation of disabled individuals:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">HB 1041 states that non-relative caregivers do not have an insurable interest in the life of a disabled person.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This makes it illegal for caregivers to be named as beneficiaries on life insurance policies.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">SB 1465: Protecting Privacy in Guardianship and Probate Disputes &#8211; Effective 9\/1\/2025<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">It is not unusual in a guardianship or <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/best-probate-shortcut-family-agreement-settle\/\"><span style=\"font-weight: 400;\">probate battle<\/span><\/a><span style=\"font-weight: 400;\"> for someone to show up with a video of the proposed ward or the decedent (while alive). SB 1465:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Criminalizes someone, without the other person\u2019s consent, and to invade that person\u2019s privacy, to record, broadcast, or transmit a visual image of the other person in a place in which the person has a reasonable expectation of privacy, such as a bathroom, bedroom, or changing area.\u00a0<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">SB 746: Limiting Interference in Guardianship Proceedings &#8211; Effective 9\/1\/2025<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">There is an ongoing problem with people who have an adverse interest in a proposed ward butting into guardianship proceedings. SB 746 prevents this by:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prohibiting individuals with an adverse interest from:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Applying to create a guardianship<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Applying for the appointment of a guardian<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Filing a motion or complaint to request the removal of a guardian or contest the request for the removal of a guardian.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">SB 922: Delayed Electronic Disclosure of Sensitive Medical Results &#8211; Effective 9\/1\/2025<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The requirement that you receive health test results immediately electronically has had some unintended effects. For some people, it has led to heightened stress, anxiety, and uncertainty, particularly if the test came back positive for cancer or other life-changing conditions. SB 922:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a0Allows for a three-day delay in disclosing sensitive test results\u00a0 (e.g., cancer diagnoses) electronically.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This allows the physician to have an informed discussion with the patient first.\u00a0<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">SB 1238: Ending the \u201cWidow\u2019s Penalty\u201d in Insurance &#8211; Effective 9\/1\/2025<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Amazingly, when someone dies, Texas law allows insurers to charge the <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/spouses-death-leads-to-complexity\/\"><span style=\"font-weight: 400;\">surviving spouse<\/span><\/a><span style=\"font-weight: 400;\"> a widow\u2019s penalty. That changes with SB 1238:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prohibits an insurer from charging a widow\u2019s penalty, and from refusing to continue to insure, provide coverage, or limit the amount, extent, or kind of coverage available to the widow.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ensures fair and continuous coverage for widows and widowers<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">Looking Ahead with Hammerle Morris Law Firm<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">These are just a few examples of meaningful legislative updates.
