{"id":13192,"date":"2025-08-31T06:00:41","date_gmt":"2025-08-31T11:00:41","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=13192"},"modified":"2025-08-29T14:58:17","modified_gmt":"2025-08-29T19:58:17","slug":"new-texas-laws-affecting-seniors-in-2025","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/legal-talk\/new-texas-laws-affecting-seniors-in-2025\/","title":{"rendered":"New Texas Laws Affecting Seniors in 2025"},"content":{"rendered":"<h2><b>The Good Stuff Just Keeps Coming<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Is it finally time?\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Thanks to the Texas legislature, state capital gains tax, estate tax, gift tax, and GST tax are well on their way to being permanently banned in Texas.<\/span><\/p>\n<h2><b>Capital Gains Tax May Be Permanently Banned<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Senate Bill 18 proposes a constitutional amendment prohibiting the imposition of a capital gains tax.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This bill was inspired by Washington State, which, despite not having an income tax, successfully imposed a capital gains tax on its residents. To avoid a similar situation in Texas, the legislature proposed making it unconstitutional to enact a capital gains tax on realized or unrealized capital gains of an individual, family, estate, or trust.<\/span><\/p>\n<h2><b>Estate, Gift, and GST Taxes Could Also Be Banned<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">House Bill 2 proposes a constitutional amendment prohibiting estate, gift, or GST <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/legal-talk\/checklist-for-2025\/\"><span style=\"font-weight: 400;\">taxes<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><b>Background<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Texas used to collect a Death Tax but then repealed it.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Currently, nothing prevents a future legislature from imposing a death tax or its related taxes \u2013 including estate, inheritance, legacy, succession, gift, and generation-skipping transfer taxes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This amendment would make all of those unconstitutional.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Both constitutional amendments will appear on November\u2019s ballot, so for goodness\u2019 sake, vote!<\/span><\/p>\n<h2><b>No More Gift Tax on Vehicle Inheritance<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Thanks to SB 2064, you will no longer have to pay a gift tax when you inherit a vehicle. The tax was only $10, but it\u2019s the principle of the thing.<\/span><\/p>\n<h2><b>Beneficiary Designation Now Available for Mobile Homes<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Texas has long allowed vehicle owners to name a beneficiary who inherits their car, but the same wasn\u2019t possible for mobile homes.<\/span><\/p>\n<h3><b>What\u2019s Changing<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Under SB 1940, if you own a manufactured home classified as personal property, you can now complete a revocable <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/beneficiary-in-waiting-rights-during-the-probate-process-can-be-complex\/\"><span style=\"font-weight: 400;\">beneficiary <\/span><\/a><span style=\"font-weight: 400;\">designation form.
