{"id":13204,"date":"2025-10-08T13:45:44","date_gmt":"2025-10-08T18:45:44","guid":{"rendered":"https:\/\/legaltalktexas.hammerle.com\/?p=13204"},"modified":"2025-10-08T13:39:25","modified_gmt":"2025-10-08T18:39:25","slug":"beneficiary-designations-in-texas-why-they-matter-and-where-you-can-use-them","status":"publish","type":"post","link":"https:\/\/hammerle.com\/legaltalk\/probate\/beneficiary-designations-in-texas-why-they-matter-and-where-you-can-use-them\/","title":{"rendered":"Beneficiary Designations in Texas: Why They Matter and Where You Can Use Them"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Most people have been hounded by their financial advisor or <\/span><a href=\"https:\/\/hammerle.com\/practice-areas\/estate-planning\/\"><span style=\"font-weight: 400;\">estate planner<\/span><\/a><span style=\"font-weight: 400;\"> to put <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/the-probate-talk-administrators-creditors-and-beneficiaries-need-to-know\/\"><span style=\"font-weight: 400;\">beneficiary <\/span><\/a><span style=\"font-weight: 400;\">designations on their financial investment accounts.\u00a0 Beneficiary designations are helpful because they indicate who is to receive the funds in the account, and that person can usually collect the account simply by providing a death certificate of the deceased owner.\u00a0 No probate is required, so it is a quick and easy way to transfer a deceased person\u2019s property.\u00a0 But beneficiary designations exist in an array of situations that you may not be aware of.<\/span><\/p>\n<h2><b>What Is a Beneficiary Designation?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">A beneficiary designation names who should receive an asset when the owner dies. In many cases, the beneficiary can claim the asset without <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/category\/probate\/\"><span style=\"font-weight: 400;\">probate <\/span><\/a><span style=\"font-weight: 400;\">by presenting proof of death, making the transfer faster and simpler.<\/span><\/p>\n<h2><b>Where You Can (and Can\u2019t) Use Beneficiary Designations<\/b><\/h2>\n<h3><b>Bank Accounts (POD\/TOD and Right of Survivorship)<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">On a cash account at your bank, the designation is more likely called a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/probate-creditor-claim\/\"><span style=\"font-weight: 400;\">payable on death<\/span><\/a><span style=\"font-weight: 400;\"> (POD) or transfer on death (TOD) designation. If you own the account with someone else, such as a spouse, then a right of survivorship (ROS or JTROS) will allow the surviving owner to claim the entire account when the other owner dies.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Note: This is not the same as having signatory authority on an account.<\/span><\/p>\n<h3><b>Automobiles (Texas DMV Forms)<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The Texas DMV has promulgated a form to place a beneficiary designation on a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/gifts-causa-mortis\/\"><span style=\"font-weight: 400;\">motor vehicle<\/span><\/a><span style=\"font-weight: 400;\"> (Form VTR-121). You submit this form, along with an Application for Texas Title and Registration (Form 130-U) and a fee, to your county tax assessor\u2019s office prior to your death. Then the vehicle title will transfer to the named beneficiary at your death, without the need for probate.<\/span><\/p>\n<h3><b>Manufactured\/Mobile Homes (Effective Sept. 1, 2025)<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Effective September 1, 2025, you may designate a beneficiary for a manufactured home. The home must be classified as personal property; the statement of ownership must not reflect that the owner has installed the home and elects to treat the home as real property.<\/span><\/p>\n<h4><b>How It Works<\/b><\/h4>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The owner must submit an application for a new statement of ownership with the beneficiary designation to occur at the owner\u2019s death.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The designated beneficiary has one year after the owner\u2019s death to claim the home by submitting another application for statement of ownership to the Texas Department of Housing and Community Affairs; otherwise, the beneficiary designation will be void.<\/span><\/li>\n<\/ul>\n<p><i><span style=\"font-weight: 400;\">(Tex. Estates Code Chapter 116, \u00a7122.001(1), and Tex. Occ. Code 1201.2135.)<\/span><\/i><span style=\"font-weight: 400;\"> Certain people are also eligible to sign a right of survivorship (ROS) agreement regarding manufactured homes. <\/span><i><span style=\"font-weight: 400;\">(Tex. Occ. Code 1201.213.)<\/span><\/i><\/p>\n<h3><b>Homes and Real Property (Community Property &amp; TODD)<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Yes, even a traditional home can have a beneficiary designation attached to it.<\/span><\/p>\n<h4><b>Community Property Survivorship (Married Owners)<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">If you are married and you purchased your home during the marriage, then the home is <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/community-property-survivorship-agreements-this-tool-deserves-another-look\/\"><span style=\"font-weight: 400;\">community property<\/span><\/a><span style=\"font-weight: 400;\">. Each spouse owns half of the home, and a deceased spouse\u2019s half does not automatically pass to the surviving spouse, as some people believe. However, it is possible to file a Community Property Survivorship Agreement in the deed records, which states that, if one spouse dies, the other spouse is to own the entire property.<\/span><\/p>\n<h4><b>Transfer on Death Deed (Single Owners or Others)<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">A single homeowner may pass the home outside of probate by signing and filing a Transfer on Death Deed (TODD). After the owner\u2019s death, the named beneficiary files an Affidavit of Death in the property records and, voila, title passes to the beneficiary without the need for probate.<\/span><\/p>\n<h3><b>Boats (Current Limitation)<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Unfortunately, the Texas Parks &amp; Wildlife Department does not permit a beneficiary designation for a vessel or outboard motor at this time. It seems odd, considering cars, trucks, and mobile homes may have a beneficiary named. However, TP&amp;W does provide a form for passing on a boat to an owner\u2019s heirs if no probate is conducted or needed on the owner\u2019s estate. The limitation is that the boat must go to the owner\u2019s legally defined heirs, and the owner cannot just designate someone to receive it.<\/span><\/p>\n<h2><b>Key Rules and Reminders<\/b><\/h2>\n<h3><b>Revocability and Priority Over Wills<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">All beneficiary designations, even those filed in the DMV or deed records, are revocable. If the owner changes their mind about who is to receive a piece of property, the designation can be rescinded or changed.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> Important: A contrary Will provision does not revoke a beneficiary designation.<\/span><\/p>\n<h3><b>Ownership Before Death<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The designated beneficiary does <\/span><b>not<\/b><span style=\"font-weight: 400;\"> have any ownership interest in the property until the owner dies.
