She named it \u201cLittle Farm.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Little Farm is considered real property. Jane\u2019s ownership of Little Farm meant that she held title to that real property.<\/span><\/p>\n<h2><b>Transferring Title Through a General Warranty Deed<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Jane eventually sold Little Farm to David. Her transfer of the title of Little Farm was accomplished by a document called a general warranty deed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In real estate lingo, Jane was the grantor of the general warranty deed, and David was the grantee.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But Jane\u2019s general warranty deed did more than just transfer title; it contained <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/business-law\/differences-between-express-vs-implied-warranties\/\"><span style=\"font-weight: 400;\">warranties<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><b>Types of Deeds Used to Transfer Real Property in Texas<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">In Texas, there are three primary types of <\/span><a href=\"https:\/\/hammerle.com\/practice-areas\/real-estate-lawyers\/deeds\/\"><span style=\"font-weight: 400;\">deeds <\/span><\/a><span style=\"font-weight: 400;\">used to transfer real property:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/hammerle.com\/legaltalk\/?s=general+warranty+deed\"><span style=\"font-weight: 400;\">General warranty deeds<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/a-deed-indeed-words-make-property\/\"><span style=\"font-weight: 400;\">Special warranty deeds<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/quitclaim-deeds-cloud-title\/\"><span style=\"font-weight: 400;\">Quitclaim deeds<\/span><\/a><\/li>\n<\/ul>\n<h3><b>What a General Warranty Deed Protects Against<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">A general warranty deed provides the greatest protection for a buyer. In it, the grantor binds herself to defend against title defects created by herself and all prior titleholders.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In our example, Jane, by signing a general warranty deed, agreed to protect David\u2019s title in Little Farm beyond claims that had been created by just her actions. She warranted to protect David\u2019s title against all claims and demands, regardless of whether they were created by her or by any previous owner of Little Farm.<\/span><\/p>\n<h2><b>Selling Property with a Special Warranty Deed<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">After receiving title of Little Farm through a general warranty deed, David decided that he was going to sell the house and acreage to Betsey. However, he conveyed title to her through a different kind of document: a special warranty deed.<\/span><\/p>\n<h3><b>How a Special Warranty Deed Limits Protection<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">A special warranty deed offers less protection to the buyer than a general warranty deed does. In a special warranty deed, the grantor warrants to defend title only against the claims and demands of the grantor and \u201call persons claiming by, through and under him.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This means that the grantor is liable only for title defects that arose during the grantor\u2019s period of ownership or through his actions.<\/span><\/p>\n<h3><b>Comparing the Chain of Title<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Let\u2019s recap. The property passed as follows:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Jane \u2192 David \u2192 Betsey<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Jane, through her general warranty deed, warranted title to David against all claims, regardless of when or how they were created. But David, through his special warranty deed, warranted title to Betsey only against claims he had created.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Betsey received fewer warranties than David had received.<\/span><\/p>\n<h2><b>Quitclaim Deeds and Why They Are Risky<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Let\u2019s sell Little Farm one more time, shall we? This time, you are the buyer.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Betsey decides she is going to sell Little Farm to you. You both agree on a price, but when it comes time to close on the sale, Betsey gives you a quitclaim deed instead of a general or <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/a-deed-indeed-words-make-property\/\"><span style=\"font-weight: 400;\">special warranty deed<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That\u2019s not good.<\/span><\/p>\n<h3><b>What a Quitclaim Deed Actually Conveys<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">A quitclaim deed provides the least protection to the grantee. A quitclaim deed conveys only the grantor\u2019s rights, if any, to the property.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Quitclaim deeds, according to the Texas Supreme Court, \u201care commonly used to convey interests of an unknown extent or claims having a dubious basis.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Clearing up any confusion, the Texas Supreme Court also opined:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cA quitclaim deed expresses upon its face doubts about the grantor\u2019s interest, and any buyer is necessarily put on inquiry as to those doubts.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A quitclaim deed gives no warranty of title.<\/span><\/p>\n<h2><b>Best Practices When Buying Property in Texas<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">When you agreed to purchase Little Farm, you should have stipulated in the <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/?s=contracts\"><span style=\"font-weight: 400;\">contract <\/span><\/a><span style=\"font-weight: 400;\">that you wanted a general warranty deed. You should also have purchased title insurance and closed through a title company.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Had you done that, then you would have received Little Farm with a full warranty of title.<\/span><\/p>\n<h2><b>Final Thought on Deeds and Title Protection<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Or, as Shakespeare put it:<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">\u201cSo shines a good deed in a naughty world.\u201d<\/span><\/i><\/p>\n<h2><b>Conclusion: Protecting Family and Legacy<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The type of deed used in a <\/span><a href=\"https:\/\/hammerle.com\/practice-areas\/real-estate-lawyers\/\"><span style=\"font-weight: 400;\">real estate<\/span><\/a><span style=\"font-weight: 400;\"> transaction directly affects the protection a buyer receives.
