Life insurance policies, helpfully marked with an \u201cL\u201d, are jumping over probate estates to end up with beneficiaries, \u201cO\u2019s\u201d, and real estate arrows straight downward through the will, \u201cW\u201d of course, to be sold and divided among 5 distributees, all \u201cX\u2019s\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Here, however, I am limited by the format. Please use your imagination as I try to explain the estate version of a Hail Mary.<\/span><\/p>\n<h2><b>What Is a Probate Asset?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">A probate asset is subject to the probate process. It is an asset that is disposed of by a person\u2019s will or by the laws of inheritance.<\/span><\/p>\n<h2><b>What Is a Non-Probate Asset?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">A <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/wills-trusts\/non-probated-revoked-will-revokes-will\/\"><span style=\"font-weight: 400;\">non-probate asset<\/span><\/a><span style=\"font-weight: 400;\"> is every asset that is not a probate asset. It passes by contractual arrangement or operation of law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That is probably clear as mud, so let\u2019s use some real-life examples.<\/span><\/p>\n<h2><b>Common Examples of Non-Probate Assets<\/b><\/h2>\n<h3><b>Life Insurance Policies<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">If you have a <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/insurance-for-me-but-not-for-thee-life-insurance-and-annuities-sidestep-creditor-claims\/\"><span style=\"font-weight: 400;\">life insurance policy<\/span><\/a><span style=\"font-weight: 400;\">, then you probably named beneficiaries for it. That is your contract with the life insurance company to pay the beneficiaries when you die. Your life insurance policy is not controlled by the terms of your will and is a non-probate asset.<\/span><\/p>\n<h3><b>Joint Accounts With Right of Survivorship<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">If you own a joint brokerage account with your spouse, and you checked the \u201c<\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/beneficiary-designations-in-texas-why-they-matter-and-where-you-can-use-them\/\"><span style=\"font-weight: 400;\">right of survivorship<\/span><\/a><span style=\"font-weight: 400;\">\u201d box for your account, then that is your instruction that your share of the account goes to your spouse upon your death. Assets held in two names do not automatically mean there is a right of survivorship; it must be stated in writing. If you did so, then the joint brokerage account is a non-probate asset.<\/span><\/p>\n<h3><b>The Pattern Behind Non-Probate Assets<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">You see the pattern: through an agreement with the company holding the asset, you have provided for the disposition of the asset upon your death. Nonprobate assets are usually life insurance, retirement accounts, payable-on-death accounts, transfer-on-death accounts, joint property with rights of survivorship, annuities, and assets in certain trusts.<\/span><\/p>\n<h2><b>Common Examples of Probate Assets<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In contrast, probate assets are not directed by contract or law, and disposition is directed by the terms of your <\/span><a href=\"https:\/\/hammerle.com\/practice-areas\/estate-planning\/wills\/\"><span style=\"font-weight: 400;\">will <\/span><\/a><span style=\"font-weight: 400;\">or, if you do not have one, then by the heirship laws of Texas. These are typically personal possessions, vehicles, your house, entity ownership, or land. They will also include assets that are usually non-probate but do not have a beneficiary or survivorship designation.<\/span><\/p>\n<h2><b>Why It Matters to Know the Difference<\/b><\/h2>\n<h3><b>Executor Authority and Asset Control<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Why is it significant to know if an asset is probate or non-probate? One reason is that an <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/your-duties-as-executor\/\"><span style=\"font-weight: 400;\">executor of your estate<\/span><\/a><span style=\"font-weight: 400;\"> only has control over the probate assets. Suppose in your will you left $1 million to your church, but your probate assets total only $125,000. Your church is not going to receive the full $1 million bequest because there simply is not enough money to fund it.<\/span><\/p>\n<h3><b>Avoiding Distribution Mistakes<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Therein lies the problem: many people fumble distributions between their will and <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/estate-planning\/keeping-track-of-your-estate-planning-documents\/\"><span style=\"font-weight: 400;\">beneficiary forms<\/span><\/a><span style=\"font-weight: 400;\">. That can lead to unequal distributions and unintended results.<\/span><\/p>\n<h3><b>Creditors, Taxes, and Estate Obligations<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">There may also be issues with <\/span><a href=\"https:\/\/hammerle.com\/legaltalk\/probate\/the-art-of-the-claim-arduous-probate-process-unfriendly-for-creditors\/\"><span style=\"font-weight: 400;\">creditors <\/span><\/a><span style=\"font-weight: 400;\">and taxes. If there is insufficient money in an estate to pay creditors, those creditors may have a claim to pull non-probate assets back into the estate. As for tax liability, the IRS is paid one way or another, and the source may include both probate and non-probate assets.<\/span><\/p>\n<h2><b>Bringing It All Together<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">If you\u2019ve been making your own diagram, then by now the X\u2019s and O\u2019s should be jumbled with a bewildering scrimmage of lines, circles, and arrows.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Touchdown!
