To\u00a0<a href=\"https:\/\/hammerle.com\/blog\/to-probate-or-to-not-probate-should-you-avoid-it\/\">avoid a probate proceeding<\/a>, most people have a trust or use documents such as beneficiary designations, Transfer on Death Deeds and Survivorship Agreements.<\/p>\n<h2>Gifting to Children to Avoid Probate.<\/h2>\n<p>Do not do this if the child is a minor, a spendthrift, a druggie, or on government assistance.\u00a0 Do not do this if you may eventually need the asset or money that is being gifted. In fact, there are very few valid reasons to ever do this.<\/p>\n<h2>Next Spouse Protection.<\/h2>\n<p>Talk about control beyond the grave.\u00a0 If you truly want to protect your children\u2019s inheritance from your surviving spouse\u2019s next spouse, the typical plan is to put assets into some type of family partnership,\u00a0<a href=\"https:\/\/hammerle.com\/revocable-and-irrevocable-trusts\/\">trust<\/a>, or corporate entity with buy-sell agreement.\u00a0 Your spouse will have to agree to the plan \u2013 otherwise you will only be able to protect your separate property and your share of the community property, and even those could be whittled away by your spouse\u2019s statutory rights.<\/p>\n<h2>Asset protection.<\/h2>\n<p>Admirable goal.\u00a0 The less exotic options are insurance, irrevocable trust (from a state that allows it to be asset- protected),\u00a0<a href=\"https:\/\/hammerle.com\/family-law-premarital-post-marital-agreements\/\">marital agreement<\/a>\u00a0and Limited Liability Company.<\/p>\n<h2>Special Needs.<\/h2>\n<p>If leaving money to a disabled person, the traditional solution is a\u00a0<a href=\"https:\/\/hammerle.com\/blog\/special-needs-trust-for-disabled-adults-and-kids\/\">Special Needs Trust<\/a>.\u00a0 \u00a0 Simple but effective.<\/p>\n<h2>Long Term Care Planning.<\/h2>\n<p>Self-fund, buy a Long Term Care Insurance policy, or do some Medicaid planning.<\/p>\n<h2>Estate Taxes.<\/h2>\n<p>Texas does not tax estates.\u00a0 The federal government estate tax and<a href=\"https:\/\/hammerle.com\/blog\/what-is-the-2019-gift-tax-limit\/\">\u00a0gift tax exemption<\/a>\u00a0is $11.58 million per person. \u00a0 If you have more than that, get professional tax advice.<\/p>\n<h2>Legacy Planning.<\/h2>\n<p>This is squishy terminology used by financial planners, insurance salespeople and lawyers.\u00a0 Sort of estate planning meets family counseling.<\/p>\n<p>Congratulations!\u00a0 You just saved yourself 3 hours of a boring power-point presentation, indigestion from a rubber- chicken meal, and thousands of dollars purchasing a one-size-fits-all trust with a pretty binder.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Want to save yourself 3 hours of a hard-sell at a \u201cfree educational seminar\u201d on estate planning?\u00a0 Here are the short answers to the teaser questions in that unsolicited mailing you received.
