Planning for the future
At Hammerle Finley Law Firm, we take estate planning one step at a time. We discuss with our clients their current financial, medical and family situation, and their plans for the future. We help our clients make decisions based on the information available to them now.
A basic estate plan should include the following documents:
- A Will
- A Durable [Financial] Power of Attorney
- A Medical Power of Attorney
- A HIPAA Release
- A Directive to Physicians
- A Designation of Guardian
- A Designation of Burial Agent
An estate plan may also include the following documents:
- A Trust
- A Transfer on Death Deed or a Ladybird Deed
- A Survivorship Agreement for Community Property
- A Cohabitation Agreement
- A Marital Agreement
- A Caregiver Agreement
- A supportive Decision Maker Agreement
- An Entity Formation
The planning process may include a discussion of assets that pass outside of a probate estate, which includes beneficiary designations and jointly held assets with the right of survivor. Many estate plans include a meeting with our clients’ designated agents to discuss their role.
